En esas fechas los bajacalifornianos celebraron su triunfo, pero meses después la trasnacional canadiense filosa simplemente le cambió el nombre al citado proyecto: Paredones Amarillos (hasta febrero de 2010 se conocía con este nombre), paso a denominarse Minera Concordia (desde septiembre del mismo año), y sin más retomó el trámite ante la Semarnat para lograr los permisos de cambio de uso del suelo forestal y otros “menores “para comenzar la explotación del área concesionada. De nueva cuenta le negaron los permisos ambientales al proyecto minero, y los bajacalifornianos volvieron a celebrar el triunfo, aunque fue tan efímero como el primero, porque las autoridades federales parece que de plano “no entienden” de qué se trata. Así la ciudadanía que son activistas sociales que se preocupan por el medio ambiente vuelven a dar la batalla, porque si en septiembre de 2010 Paredones Amarillos se “transformó” en Concordia, a partir de febrero de 2012 ésta se convirtió en Los Cardones, tras la asociación empresarial (40-60 por ciento) de Vista Gold con el Grupo Invecture, el cual cuenta con su propia concesión minera en el estado de Sonora (mina de cobre Piedras Verdes). Explican que el proyecto “tiene serios inconvenientes, porque además de tratar de ubicarse en la Reserva de la Biosfera Sierra de la Laguna, que es nuestra principal fuente de agua, también liberaría más de 100 millones de kilogramos de tóxicos, entre ellos arsénico suficiente para envenenar a toda la población del país, además de plomo, cromo, uranio, torio, etc. Todos estos materiales pesados y radiactivos quedarían atrapados en los jales, con una cortina superior a 80 metros, construida con las rocas desechadas en la tepetateras, compactadas y cubiertas con un plástico de solo 1.5 mm de espesor. Todo lo anterior “no da ninguna seguridad de que los contaminantes se van a quedar almacenados para siempre, sino más bien que se liberarán gradualmente conforme esta estructura empiece a deteriorarse, o lo que es probable, se deteriore en un solo evento, debido a una falla estructural, un sismo o a un peligroso huracán. Los ciudadanos organizados nos negamos a que nos impongan el proyecto tóxico, pero el sordo gobierno federal sólo facilita el camino a la trasnacional minera, y a la muerte lenta del mexicano envenenado por el tóxico medioambiente. El presidente de ICPA, Peter van der Sande (PVS) señala que en el mundo se presentan los mismo problemas de hacinamiento, sobrepoblación e inseguridad dentro de las prisiones, lo que se atribuye en buena medida a deficiencia en las instalaciones. “Más de 10 millones de personas han pasado por la prisión preventiva en el mundo; en este momento no hay un sistema de justicia penal que no pase por la prisión preventiva (…) pero hoy la cárcel está considerada como una institución más compleja que requiere mayor atención”. Además de la saturación de espacios, indicó PVS que otro de los problemas que genera es la posibilidad de violentar derechos fundamentales, al apartarse los plazos de este tipo de encierro. “Viola el derecho de tener un juicio expedito; los legisladores deben tener en cuenta que esto también genera sobrepoblación, ya que es urgente y necesario controlar el volumen mediante el uso de alternativas”, dice PVS. Si incluimos el impresionante incremento de los procesados y sentenciados por delitos federales durante el sexenio (de 3 mil 164 a 18 mil 283 entre 2006 y 2011, un aumento de 500 por ciento) podría considerarse un éxito en la lucha contra la delincuencia si ellos se reflejara en una disminución de la inseguridad pública. Pero ésta se ha extendido, agravado y multiplicado de forma rotunda en el presente sexenio. Esto nos indicaría que la sociedad ha generado más presos de los que encarcela, que muchos de los presos son inocentes, o ambas cosas. De cualquier forma, lo realizado en el curso de esta administración en materia carcelería no puede ser considerado un éxito, ni en forma aislada ni en el marco de la estrategia de seguridad. La reforma constitucional en materia educativa del presidente Enrique Peña Nieto (EPN), significa un “Quinazo al estilo siglo XXI” por la vía de la ley y las instituciones contra Elba Esther Gordillo, la maestra vitalicia del SNTE, consideró la Coalición Ciudadana por la Educación (CCE). El actual presidente ha señalado que el Estado es el rector de la política educativa, dará a conocer los detalles de dicha iniciativa, con la que se pretende reformar el artículo tercero constitucional, modificar la Ley General de Educación (LGE) para establecer “reglas claras” en el servicio profesional de la carrera docente. El proyecto busca crear un Sistema de Información y Gestión Educativa mediante un censo de escuelas, maestros y alumnos, así como establecer el referido servicio profesional a partir de un sistema de concursos (esta base de datos ya existe en las escuelas privadas). Aunque es de reconocer que este proyecto además de establecer como válido el dinero que se pedía como cooperación y ahora es necesario para que la escuela federal funcione, y desde luego privatizar el servicio federal y estatal. La movilidad social va en sentido inverso al éxito escolar En un país donde está pauperizada la vida de las familias, en el que se han deteriorado las condiciones sociales de padres y niños, así como los derechos económicos con salarios de miseria, y grupos numerosos que se desplazan al interior y exterior del país, la posibilidad de éxito escolar “camina en sentido inverso”. En esta circunstancia el INE reconoce en el informe 2009-2012, que en México se ha incrementado la conclusión en la primaria, el rezago en secundaria se encuentra “en franco ascenso”. En ocasiones, la cifra de desertores en ese nivel escolar es mayor respecto de quienes lo terminan. Por ejemplo, según el organismo, en 2011 entregó 35 mil certificados de secundaria en el estado de México, pero 65 mil niños abandonaron esos estudios. La evolución de este rezago ha sido la siguiente, según el INEA: en 1970 había 4.8 millones de personas sin secundaria; la cifra creció en 1980 al llegar a 9.2 millones. En 1990 aumentó a 11.9 millones, y para 2000 sumaron 14.9 millones hasta llegar a 16.4 millones que no cuentan con esos estudios básicos. Pese al retraso educativo la anterior administración federal incumplió con la meta de combatir este problema, por lo que quedaron un millón 100 mil personas de entre 15 y 39 años de edad pendientes de brindarles esos estudios, pues la meta era llegar a 3 millones. El entorno de México En los últimos días se ha desatado una furiosa campaña contra Calderón en algunos medios. Curiosamente algunos personajes de la política y el periodismo, que le cantaron alabanzas durante el sexenio se han vuelto contra él. Vaya que extraño. Pero este no pretendía ser el tema del párrafo, sino la “brillante actuación” del presidente del Consejo Coordinador Empresarial (CCE), Gerardo Gutiérrez Candiani (GGC), sufrió un golpe a su orgullo y todavía anda investigando con quién perdió. Sorpresivamente la Comisión Nacional de los Salarios Mínimos acordó unificar los salarios que han estado vigentes en tres distintas zonas del país. Los unificó con el “más alto”. El de la Zona “A”, a la que corresponde el D. F., aunque la diferencia es de centavos, el sector al que representa el CCE, que bien que no son todos los empresarios del país, afortunadamente. Sin embargo GGC, se sintió burlado porque no se tomó en cuenta su opinión. La homologación la acordaron los representantes sindicales y del gobierno, pero todavía esperamos el gran aumento de diciembre de dos pesos. Seguimos en suspenso con la presidencia del inquilino de los Pinos con una imagen insospechada pero continua trazando líneas conocidas. El interés descansa en confirmar las facciones mediante el análisis de cuotas y perfiles. Es un gabinete predictible, como el vicepresidente Luis Videgaray, dependiente de Pedro Aspe, con un cártel de gobernadores ganando favores e inversiones; Miguel Ángel Osorio Chong y Jesús Murillo Karam, y tratando de sustentarse como eje político a Emilio Chuayffet en la SEP, tratando de convertirse en un toro embistiendo con fuerza a Elba Esther Gordillo, y por otro lado el magno poder de Televisa y TVAzteca como élite empresarial, y como entes rectores sin necesidad de poner personeros explícitos. Esta cobija jaloneada no nos habla del interés de la iniciativa privada, la cual tiene a un conjunto de profesores como,”esclavos laborales”, de los cuales ellos utilizan ésta base de datos, con papelería personal de los docentes como si fuera propia, y los inscriben dentro de su sistema educativo privado en áreas tales como: escuela semi-escolarizada, bachillerato BGC, y escuela técnica, aunque ya no se encuentren dentro de su nómina laboral. Las escuelas privadas trabajan dentro de una protección del gobierno federal o estatal, y en este contexto los organismos que pueden intervenir para mantenerlos dentro de la legalidad y falta de honestidad, tanto la Profeco, el Itai, como la PGR, no funcionan. Esta misma situación se replica en la Universidad privada, los maestros son productos desechables y se cambian como cambiar un mesabanco o un pizarrón, en contraste con la universidad estadounidense. Ellos son trastes rotos y desechables. Los especialistas señalan que de concretarse la reforma constitucional, los cambios a la LGE y el fortalecimiento a las instituciones autónomas se dará un golpe a la maestra vitalicia, sin que haya necesidad de “quitarla”. También al eliminarse el control férreo sobre la vida profesional de un millón 600 mil personas y el Estado recupera el derecho de propiedad que tiene sobre las plazas su poder se “desmoronará”. Nacional Esclarecer y sancionar la represión El atropello del uno de diciembre: 1-D Por: Carlos Damián 11 de Diciembre, 2012 El desenlace parcial del atropello México. – La liberación por falta de pruebas de 56 de los 70 ciudadanos que aún permanecían encarcelados desde el 1 de diciembre, dictada ayer (9/12/12), por la jueza Patricia Mora Brito, constituye un rotundo desmentido a las versiones oficiales del gobierno federal y de la autoridad de la capital, sobre lo ocurrido ese día, en el contexto de la toma de posesión de Enrique Peña Nieto (EPN), como presidente que obliga, a cuestionar el fundamento legal de los procesos iniciados contra los 14 presos restantes y deja en entredicho el accionar de las fuerzas del orden. En efecto: podría entenderse que, durante la confusión marcada por el vandalismo y ataques contra las corporaciones policiales, estas hubiesen incurrido en error en unas cuantas de las docenas de detenciones realizadas; pero si el 80 por ciento de los arrestados y encarcelados son inocentes, como lo señala el fallo judicial y como consta en numerosas pruebas videográficas, el dato sólo puede ser interpretado como expresión de una asombrosa ineptitud en el mejor de los casos. En el peor de los casos, podría ser cierto que en cumplimiento de órdenes que exigían capturar a personas no involucradas en los delitos cometidos ese día. Significativamente, muchos fueron encarcelados y golpeados por el simple hecho de ejercer su libertad de expresión y manifestación, como lo indican los documentos recabados y ampliamente difundidos en las redes sociales y por algunos medios impresos y electrónicos. Sin embargo es necesario, en corto que las autoridades ofrezcan una disculpa a sus víctimas por las arbitrariedades y los agravios que sufrieron, entre ellos la semana que pasaron en la cárcel sin haber cometido delito alguno. Desenlace grave y torpe Se han dejado libres a 56 de los detenidos por resolución judicial por los sucesos del pasado uno de diciembre significa cuando menos lo siguiente: El gobierno de Marcelo Ebrard ese día permitió un operativo policíaco muy injusto y torpe; que son infundadas las pretensiones de ciertos periodismo oficialista, y sus comentaristas adjuntos, de vincular delictivamente la protesta ciudadana con la comisión de delitos. En este momento no se avizoran líderes a la vista, implicaciones de partido, o del tipo electoral pero la comunidad activista social de la capital, pudo enfrentar el amago de EPN urgido de imponer “orden” y de sus aliados cupulares de la capital. Entre los cuales podemos distinguir a: Marcelo Ebrard, Miguel Ángel Mancera, y Manuel Mondragón y Kalb. Por otra parte, diversas grabaciones de video indican que los verdaderos violentos fueron tolerados por los propios cuerpos policíacos y cabe preguntarse, si algunos de los responsables materiales de los destrozos llegó a ser detenido y si hay algún culpable real entre los 14 que el pasado domingo recibieron auto de formal prisión. Varios de éstos últimos, en todo caso, han exhibido constancias de comportamiento cívico y pacífico. Pero en dado caso que la parte acusadora llegará a probar la culpabilidad de los imputados, resultaría inverosímil que sólo 14 personas hubiesen protagonizado la enorme violencia vandálica que se abatió el uno de diciembre en el primer cuadro de la ciudad capital. De modo que a algunos días de ocurridos los hechos, sigue sin saberse quiénes agredieron a las fuerzas el orden y causaron los destrozos. Lo cual nos indica esta lectura de los designios de encubrimientos provocación y represión, surgidos desde algunas oficinas públicas a cargo de la administración de EPN. El primer saldo de las batallas del 1DMX podría aportar lecciones a las partes en conflicto y ayudar a disminuir riesgos a lo largo del tramo sexenal de EPN, que ya se avizora por los hechos mencionados una situación compleja. El aspirante a candidato presidencial 2018, ha cometido uno error político, al ordenar una represión extemporánea e ineficaz, pues los verdaderos causantes de los destrozos en la avenida Juárez ya se habían esfumado. De los 69 acusados solo 56 fueron liberados por falta de pruebas. Estos errores que cometieron sería en otros países una virtual sentencia de muerte política a tan tragicómica represora. Resulta procedente y necesario, que la PGR y PGJDF, llamen a declarar a quienes ese día fungían como mandos de las fuerzas federales y de las capitalinas. De no proceder al esclarecimiento de estos atropellos y al castigo de los responsables materiales, intelectuales y políticos, el Estado estará enviando un mensaje de impunidad y ruptura del estado de derecho. Nacional México está inmerso en la globalización de la miseria El manual neoliberal Por: Carlos Damián 13 de Diciembre, 2012 El sistema del PRI no da un paso atrás en el sistema económico de derecha México. – La globalización ha sido un proceso esencialmente financiero, las corrientes de dinero y de crédito alcanzaron una escala realmente mundial en la década pasada. El extremo de ese fenómeno se volvió claramente apreciable cuando estalló la crisis de 2008. Desde entonces el comportamiento de la economía está asociado de modo estrecho con las pautas del ajuste exigido por la dislocación de los flujos de capital y que abarcan de modo central a las finanzas públicas. El alcance y los matices de ese ajuste son globales. También se provocó una transformación productiva y uno de sus elementos relevantes fue el cambio de localización de la actividad manufacturera, el caso de México en los sectores automotriz, electrónico, eléctrico, de enseres domésticos e incluso el aeronáutico. En política económica, no daremos un paso atrás. A pesar de los malos resultados reportados en 30 años, podemos incluir en esta perspectiva el crecimiento raquítico, el aumento de la pobreza en el país, salarios de miseria y galopante precarización del empleo. La nueva administración gubernamental insiste en mantener inalterada la ruta trazada en el manual neoliberal, de tal suerte que sin mayores problemas. México permanecerá tal cual y en espera de algún acto de magia para que mejore su futuro. El paquete económico 2013 presentado al Congreso el pasado viernes (7/12/12), confirma que el gobierno manejado por el PRI, no moverá ni un solo dedo para cambiar un giro, así sea mínimo, a la ruta del “navío de gran calado”, de acuerdo a palabras de Calderón. Nada nuevo bajo el sol, porque para despejar dudas no se altera la política económica heredada del anterior gobierno del PAN, los intereses permanecen intocados del poder fáctico, de las televisoras y de las radiofónicas, de las cúpulas empresariales, de los viejos sindicatos nacionales que ejercen un férreo control, en fin, todo permanece igual que en los últimos 30 años, según promesa del gobierno entrante iba a ser más importante el bolsillo de las familias mexicanas. Lo cual dicho sea de peso, es exactamente la misma oración que sistemáticamente hicieron pública las cinco administraciones anteriores, y que obvio, ellos han incumplido abierta y descaradamente. El inquilino de los Pinos ha hecho sus declaraciones en la cual ensalza y glorifica el derecho del pueblo mexicano a una buena educación; que van a dejar atrás la desigualdad económica y la pobreza. Los mexicanos queremos un cambio. Pero parece que el presidente actual desaprovecha la oportunidad para comenzar la transformación por él ofrecida. Su primer paquete económico sólo ofrece más de lo mismo, es decir, un concepto y una práctica económica que ha concretado exactamente lo contrario de lo que se queja, Enrique Peña Nieto (EPN). Sólo palabras amables hacia el pueblo pero el sistema neoliberal encabezado por EPN insiste por la ruta fallida, por sus compromisos cupulares antes de la campaña política. Se mantienen intocados los sectores con enormes privilegios fiscales como son; los barones de la minería y sus mágicas concesiones de 56 millones de hectáreas de territorio nacional, pero el gobierno federal espera captar y gastar el gobierno de EPN a lo largo de este año, aunque los ingresos provendrán de los mismos renglones y actividades desde hace 30 años. Casi la mitad del presupuesto de egresos se canalizará al pago de nómina burocrática, servicio de la deuda tanto interna como externa y el aparato de seguridad nacional. Una tercera parte del gasto canalizará a los estados de la República, vía aportaciones y participaciones federales, pero como el cuento de niños el presupuesto se habrá agotado. En este recuento de gastos económicos, el inquilinos de Los Pinos tiene un enorme aparato operativo y consumirá 2 mil 104 millones de pesos. La Secretaria de la Defensa Nacional el gasto equivale a casi 61 mil millones de pesos, que se suman a los 22 mil millones de la Marina, los 16 mil de la PGR, los 41 mil de Seguridad Pública, y los 21 mil de gobernación. Diputados y senadores tragarán 12 mil millones de pesos; el Poder Judicial, 47 mil millones, el IFE, 11 mil millones, EL INEGI, 5 mil 500 millones, y la CNDH apenas un mil 375 millones. Como ya es tradición el PRI siempre ha sido un gobierno manirroto, y en 2013 se gastará más en el servicio de la deuda que en educación pública (350 mil contra 251 mil millones), y el fomento económico por medio de la Secretaría de Economía, resultará tres veces inferior a los dineros canalizados a la Secretaria de la Defensa Nacional (SEDENA). Sin embargo el renglón más importante, la generación de empleos a través de la Secretaría del Trabajo se consumirán diez veces menos que el presupuesto destinado a la Secretaría de Marina. Por otra parte los ingresos presupuestarios, el gobierno estima obtener un total de 3 billones 931mil 289.5 millones de pesos. De este total, 2 billones 477 mil 22.5 corresponderán a ingresos del gobierno federal, un billón 98 mil 977.4 por ingresos de organismos y empresas, y 355 mil 289.6 por ingresos derivados de financiamientos”. “Congruentes con estos ingresos, se calcula que la recaudación federal participable se ubicará en 2 billones 117 mil 290.7 millones”, indica la respectiva iniciativa de ley. La SHCP propone al Congreso que, en materia del ISR para las personas físicas que aplique la tarifa vigente al 31 de diciembre de 2012, manteniendo la tasa marginal máxima en 30 por ciento. En este sentido, es claro que todavía existen riesgos importantes en el entorno económico internacional, por lo que las medidas de 2009 se prolongarán. Un negocio rentable y productivo Desde que el ex presidente George W. Bush promulgó la ley “No child left behind”, donde se establece el uso de los resultados de exámenes estandarizados estatales a estudiantes para medir el desempeño de maestros y escuelas, que en algunos casos lleva al despido de docentes y hasta la clausura de planteles educativos. Llevándose a cabo estas directrices desde 2002, convirtiéndose en pieza central del movimiento de reforma a la enseñanza pública. Con este antecedente se ha obligado a que los maestros y administradores dediquen cada vez más tiempo, atención y esfuerzo a estas pruebas de la federación, que determinan a su vez el futuro de los administradores, los docentes, los estudiantes, y de la escuela misma. A su vez Barack Obama para no quedarse atrás en el interés por el futuro de la educación, se obligó al secretario de educación a formular un programa llamado RTT (Race to the top), el cual promueve la competencia entre estados para ampliar el uso de estos exámenes, la elaboración de medidas y programas para la evaluación estadística de estudiantes y maestros con base en tales pruebas educativas y desde luego la creación de más escuelas chárter a cambio de fondos federales. En este entorno educativo se han formado las NCLB y RTT como coronas del movimiento empresarial que están reformando el sistema educativo. Este movimiento empresarial argumenta que con base en estas reformas, los maestros serán evaluados con objetividad y ahora se cuenta con un proceso de rendición de cuentas al sistema educativo nacional estadounidense. Es increíble que un sistema educativo como el estadounidense se base en unos exámenes que están en discusión por la información sesgada que se obtiene; vas a obtener la estadística y resultados que quieres si los reformadores los han creado. Nacional Ellos han creado un perro bravo, sin dientes El tribunal de transparencia de información nacional Por: Carlos Damián 9 de Noviembre, 2012 Se necesita un órgano con total independencia del presidente de México México. – El PRD en la Cámara de diputados planteó reformar la Constitución con el fin de extinguir el Instituto Federal de Acceso a la Información Pública (IFAI) y sustituirlo por un tribunal de transparencia dependiente del Poder Judicial de la Federación. En una iniciativa al respecto, el vocero de la fracción del PRD, Carlos Reyes Gámiz (CRG), explicó que con ello se constituiría en un órgano independiente del Ejecutivo federal y se fortalecería de manera definitiva el derecho el acceso a la información pública. Al explayarse CRG, dijo que el IFAI se ha convertido en un “perro guardián sin dientes” al ser finalmente, un organismo de la administración pública cuyos integrantes son nombrados por el presidente de México, por lo que carece de capacidad de coacción gradual cuando las otras áreas de la administración se niegan a acatar sus resoluciones. Así que en realidad este órgano sólo tiene capacidad de dar vista al órgano de control interno de esas instancias, por lo que no garantiza el acceso a la información pública, y cuando ésta se niega a los ciudadanos deben recurrir a juicios de amparo ante el Poder Judicial, y sólo si ganan el recurso se les entregan los datos solicitados. Sin embargo, “la información que no llega a tiempo, no sirve”, indicó CRG. La Iniciativa propone reformar la fracción cuarta del artículo sexto constitucional en el cual se defina establecer mecanismos de acceso a la información y procedimientos de revisión expeditos por parte de órganos especializados, imparciales y con autonomía de operación, gestión y decisión. Datos y documentos obtenidos mediante la ley Federal de Transparencia revelan que durante poco más de tres años en que María Elena Pérez-Jaén (MEPJ), se ha desempeñado en este cargo, registra 13 viajes al extranjero con un costo al erario cercano al medio millón de pesos. La comisionada del IFAI, realiza viajes al extranjero con frecuencia. MEPJ ha visitado en “comisión” diversos países como: Australia, Nueva Zelanda, Corea del Sur, Hong Kong, India, Brasil y Chile. En el viaje a Hong Kong, (del 9 al 18 de junio de 2012), el erario pagó 84 mil 227 pesos en boletos de avión y 23 mil pesos 378 pesos por concepto de viáticos. La comisionada estuvo fuera del país durante 10 días (6 de estos hábiles) y sólo participó el 16 de junio en un panel; el resto de las actividades se suscriben a reuniones con miembros del consulado mexicano y asistencia a foros. Al llegar al país asiático, el 11 de junio, sólo consigna una reunión con el cónsul general de México para conversar sobre la exposición a realizarse el día siguiente. Las crónicas de las participaciones en general no cumplen a cabalidad con los que establecen los lineamientos internos para la asignación de viáticos y pasajes nacionales e internacionales para las comisiones en el desempeño de sus funciones. El Consejo Coordinador Empresarial sugiere que se fije un límite no mayor a 40 por ciento. Sería mejor 30 por ciento, pero esta meta ya fue rebasada. El CCE no es la entidad adecuada para hacer recomendaciones, pero conviene atender su llamada de atención, y aunque no se han detenido a pensar en que el Fobaproa, ese cáncer de la sociedad herencia del sistema neoliberal ha agregado 120 mil millones de dólares a la cuenta de la deuda nacional. Para pesar de la nación mexicana el PRI que ha llegado a la silla presidencial está dando señales que gastará hasta el dinero que no se encuentre en el erario público siguiendo la línea económica de Calderón. Según informes estadounidenses algunos republicanos miembros de la cámara de representante de Estados Unidos, la famosa operación Rápido y Furioso fue concebida y ejecutada con la pretensión de afectar al cártel de Sinaloa. Pero lo cierto es que la organización de traficantes dirigidas por Ismael Zambada y Joaquín Guzmán ha recibido a lo largo de las dos administraciones federales del PAN una notable protección, y que el saldo de la “guerra” de Calderón ha resultado marcadamente favorable para el cártel mencionado.
