Estos grupos de maestros que se oponen como JH, ellos afirman que no están en contra de la evaluación de maestros y escuelas, de hecho sus colegas han elaborado alternativas que ofrecen medir todo tipo de capacidades que no se registran por los exámenes estandarizados. “Estamos en contra de evaluaciones que no son culturalmente relevantes, no alineadas con nuestro curriculum, y que no promueven el tipo de capacidades que creemos son necesarias en el mundo hoy”. Sin embargo lo más sorprendente ha sido el movimiento de padres, maestros y estudiantes en Texas, donde la legislatura estatal, que obligada por la presión popular, aprobó a finales de abril medidas para reducir el número y uso de los exámenes estandarizados en el estado. Esto sucedió en la cuna de la reforma educativa que se ha promovido a escala nacional. Esta revolución empezó con un grupo de ocho madres de familia en Austin y Houston, a quienes todos descartaron por ser “novatas” en la política. Pero su furia contra los mandatos estatales que sometían a sus hijos cada vez más a exámenes estandarizados y los efectos que esto tenía sobre la enseñanza impulsó una organización que al final “abrumó a las fuerzas empresariales y políticas que habían convertido a Texas en la capital experimental de los exámenes estandarizados”. Mexicana de Aviación (MA), por ejemplo, alcanzó acuerdos con 51.31 por ciento de sus acreedores, mientras Mexicana Inter llegó a 75.71 por ciento. El porcentaje mínimo de conciliación para alcanzar un convenio concursal es de 50 por ciento. El convenio concursal es el paso que sigue a la etapa de conciliación en este concurso mercantil, que hasta el momento ha durado 32 meses. La Secretaría de Comunicaciones y Transportes (SCT) podría vetar los convenios concursales que presente el conciliador GB para sacar del concurso mercantil a MA, porque en apariencia no hay un inversionista interesado o la juez lo tiene reservado, señaló el abogado de los trabajadores de tierra de MA, Joaquín Ortega Esquivel (JOE). En este acuerdo en la que los posibles compradores se les pide su propuesta monetaria, ésta queda en depósito de Nacional Financiera pero si ellos pero este dinero queda en manos de mexicanos corruptos ya que si en cualquier momento tienen el deseo de tomar el dinero lo pueden hacer con discreción y las leyes se los permite y se llevan el dinero sin darle cuenta a nadie. El abogado detalló que en este momento los trabajadores están a la espera de que se exhiban los convenios concursales que el conciliador entregó al juzgado decimoprimero de distrito en materia civil, y si más de 50 por ciento de los acreedores se adhieren a ellos serán obligatorios para los que no los hayan aceptado y entonces la juez EA podrá levantar el concurso mercantil. Sin embargo advirtió el abogado, que el riesgo está en qué la SCT puede manifestarse en contra de los convenios, porque al no haber un inversionista definido no habrá condiciones para reactivar la empresa ni a quién entregarle el certificado de operador aéreo (COA) indispensable para toda aerolínea, y que se entrega luego de que la empresa demuestra que tienen capacidad financiera, jurídica, administrativa y técnica para operar. La estrategia de Mexicana Explicó que hasta el momento la juez no se ha manifestado sobre si uno de los dos inversionistas que presentó documentos para demostrar que tiene los recursos para sacar a MA del concurso mercantil y reactivarla fue aceptado, o si ninguno cumple loas requisitos, incluso se mantiene reservada su identidad aunque las versiones son de que uno de los interesados en MA es Fides y el otro la versión Mexicana de Med Atlántica. “La juez se tenía que pronunciarse sobre los inversionistas pero no lo ha hecho porque está a la espera de que la SCT vete los convenios concursales. La estrategia que está siguiendo es buena, porque si la SCT veta los convenios con el argumento de que no hay un inversionista que los haga viables y ella tiene uno que sí, habría otro escenario”. Sin embargo, alertó el abogado, es poco probable que las cosas sean diferentes porque el interés de la SCT es que se cumplan todos los procedimientos legales, pero que MA se vaya a la quiebra. Señaló JOE que con todas las quitas que haya logrado el conciliador las deudas de MA siguen siendo muy altas incluido un crédito fiscal que no es de MA sino de retenciones que hicieron Bancomext y Banorte, además de que ahora las condiciones son más adversas que hace casi tres años, cuando la empresa entró en crisis. Se intenta reactivar a MA Los trabajadores de MA ante la Junta Federal de Conciliación y Arbitraje (JFCA) un “secuestro provisional de los bienes”, lo cual consiste en que el conciliador y administrador de la empresa, Gerardo Badín, firme un convenio con pilotos, sobrecargos, trabajadores de tierra, y de confianza para que ellos sean quienes reactiven la aerolínea en seis meses. El abogado, explicó que la JFCA, deberá resolver este recurso a lo largo de la semana después del 18 de mayo, y sería una salida muy conveniente para el conciliador y para los trabajadores, y que la SCT tendría que acatar si es que se mantiene en su postura de respetar las decisiones de la rectora del concurso mercantil. En tanto se espera que este día (17/5/13), la juez federal EA, responsable del concurso mercantil de MA, se reúne al mediodía con tres probables inversionistas que buscan rescatar de la quiebra la aerolínea, entre ellos Iván Barona, quien ha sido rechazado por lo menos en tres ocasiones para este juzgado. En otro frente de este conflicto, los integrantes de la Asociación de Jubilados, Trabajadores y Ex Trabajadores de la Aviación Mexicana (AJ Team), informaron que el día (16/5/13), enviaron una carta a EPN, y a los Secretarios de Trabajo y de SCT, Alfonso Navarrete y Gerardo Ruiz Esparza, respectivamente. Para solicitarles su intervención “de manera inmediata” a fin de que se diseñe una estrategia gubernamental que soluciones el conflicto, que no sólo perjudica de manera directa a los trabajadores, sino también a los usuarios del servicio aéreo. JOE detalló que mientras el proceso avanza con la juez EA, ellos presentaron ante la JFCA un recurso para llegar a un convenio con el conciliador GB, que consiste en un “secuestro provisional de los bienes”, basado en que el interés principal en este conflicto es el derecho al empleo y su preservación. Con el “secuestro provisional de bienes” los trabajadores estarían en condiciones de tener recursos para regresar a volar. Tal vez el secretario general de la OCDE, José Ángel Gurría (JAG), desea concretar todas aquellas reformas estructurales que no pudo concretar como secretario de Hacienda que fue de Ernesto Zedillo. Esta información sesgada nos indica que el Estado como se ha documentado por años, es el que asume todos los riesgos y los elevados costos, ya que como siempre es el sector privado el que goza de los jugosos beneficios. En este tejemaneje es el viejo truco de la socialización de las pérdidas y la privatización de las ganancias. En esta fábrica de mentiras en la que la OCDE nos “recomienda” la “reforma privatizadora” en el sector energético, y en tal sentido nos encontramos con la pregunta obligada, si el oro negro se cede gratuitamente a las grandes trasnacionales extranjeras y mexicanas, ¿de donde obtendrá recursos el gobierno federal? Porque, aproximadamente de 40 centavos de cada peso presupuestal proviene del petróleo y al gran capital nunca se le ha dado eso de pagar impuesto al gobierno federal. Primero se cede el alma al diablo que pagar impuestos al gobierno mexicano. El gobierno federal y estatal se vacíe el cerebro para encontrar de donde provienen los impuestos, ya que el gran capital con su docena de abogados, busca evadir, encuentra que le devuelvan los impuestos y se rehúsa a pagar impuestos. Pero sorpresa, viene la sirena con su canto y “recomienda” otra fabulosa “reforma” con sus artes de brujería: IVA en alimentos, medicinas, libros, servicios médicos, colegiaturas y todo lo demás que a la fecha no está gravado con ese impuesto o tiene tasa cero. Los mexicanos sabemos que el gobierno no compensará, el gran agujero fiscal que se provocara al privatizar la ganancia petrolera, pero el organismo que maneja JAG está feliz con la posibilidad que su idea la concrete el gobierno de EPN. Con la brillante idea del canto de las sirenas, los más pobres verán subir el pago de este impuesto 161.2 por ciento, mientras para los más ricos aumentará menos del 40 por ciento. Golpeará financieramente a Hacienda que compensará con los ingresos y utilidades de la paraestatal que ya no cobra, y además devolverá los impuestos a las grandes empresas como Televisa. En esta certeza de la información nos encontramos con la aplicación generalizada del IVA en alimentos y medicina, se eliminan los supuestos subsidios a los precios de la energía eléctrica y gasolina. Se aplicarán impuestos al comercio informal, y a la economía informal además de un aumento al IVA, del 16 por ciento al 20 por ciento. En total, con estas cuatro categorías se concentran 81.7 por ciento. Sin embargo para el 20 por ciento de la familia con menores ingresos, 52.3 por ciento de su ingreso se destina a la adquisición de alimentos, en contraste con 28.4 por ciento de su gasto que canaliza la familia rica en la compra de alimentos, por esta razón, un gravamen del IVA en alimento afectaría de forma significativa a las familias menos favorecidas, (eufemismo para referirse a las familias miserables). Con la estructura actual del impuesto, las familias ricas pagarán 41.1 por ciento del total de IVA, y 1.1 por ciento pagarán IVA, del 10 por ciento del segmento considerado como familia menos favorecida (o miserable). Donde antes sólo el 62 por ciento de la familia mexicana más pobre estaba exento de este pago, y sólo el 38.2 por ciento pagaba impuestos. Del total la familia rica sólo pagaba las tres cuartas partes del gasto, IVA. En este aumento generalizado de precios y de impuestos el efecto de la reforma fiscal será diferente para la población, ya que será de acuerdo a los ingresos recibidos. La última encuesta nos muestra como un fundo minero con trece familias dueñas de México, manteniéndose la concentración de la riqueza (del 1 por ciento). Los hogares de menos ingresos perciben 5 por ciento del ingreso total, mientras que las familias ricas (1 por ciento), concentran el 51 por ciento del ingreso total. Medido en función de los salarios, la mayoría de las familias mexicanas percibe de 2.01 a siete salarios mínimos, un rango de 126 a 442 pesos diarios. La prioridad en el gasto de la familia mexicana se registra en alimentos y bebidas (36 por ciento del total del gasto), seguido de transporte (20.4), educación y esparcimiento (15) y vivienda y servicios (10.3). La baja recaudación de impuestos se explica de acuerdo al estudio de la OCDE, por el predominio de exenciones y regímenes especiales en los sistemas de sobre la renta, a las empresas y las personas físicas, así como el IVA que equivalen a 3.1 por ciento del PIB, o alrededor de 16 por ciento de los ingresos públicos reales. Se pueden considerar gastos tributarios: tasa cero para alimentos (incluidos los elaborados) medicinas, y otras exenciones como los servicios educativos y médicos, tarifas reducidas en la frontera, entre otros. "Las reformas podrían comenzar con la eliminación de las lagunas potenciales, tales como la tasa de frontera y la falta de retención de impuestos de importación para la industria maquiladora. Se debería volver a examinar la canasta de productos que tienen tasa cero o están exentos, ya que los objetivos sociales se atienden mejor a través de transferencias directas", se propone en el estudio. La tasa de impuesto al valor agregado es de 16 por ciento y de 11 por ciento en las franjas fronterizas. El organismo ha inventado el hilo negro al “recomendar” que la reforma fiscal que el gobierno cuece en grandes recipientes, con grandes cantidades de dinero para convencer a políticos y extraños, que aprobarán en el segundo semestre del año 2013, sean revisadas las exenciones o tasas cero que existen en el cobro del IVA a algunos bienes.
