Nacional Ocho mil trabajadores dicen, ¿hasta cuándo se resolverá el problema de las pensiones? Los pensionados de Mexicana Por: Carlos Damián 10 de febrero, 2014 Los fondos de los jubilados no “fueron tocados”. México. - Un grupo de trabajadores de la Compañía de Aviación sostuvo ayer (6/2/14) un enésimo encuentro con integrantes del fideicomiso que administra la aerolínea Mexicana, descapitalizada y arruinada por su ex propietario Gastón Azcárraga, con el propósito de lograr el pago de las pensiones que se les adeudan desde hace meses. Como se recordará Mexicana, tras ser “rescatada” y saneada con dinero público, fue “desincorporada” en 2005, durante el sexenio de Vicente Fox, y vendida al Grupo Posadas (dueña del complejo hotelero), donde Azcárraga era accionista mayoritario y algunos dijeron que fue “malbaratada”, al grupo fáctico de Televisa. En menos de cinco años, la administración privada desmanteló la empresa y la llevó a una virtual quiebra, que dio lugar a un concurso mercantil que aún no se ha resuelto. En el proceso, los afectados inmediatos han sido los trabajadores, entre los cuales podemos anotar a técnicos y manuales, administrativos, sobrecargos y pilotos, y entre ellos; los jubilados, personas que en realidad han sido los más perjudicados, pues carecen de posibilidades de obtener otro empleo. Pero el prolongado cierre de las aerolíneas ha sido también horriblemente oneroso para el país y para la economía, particularmente para el sector turístico y los usuarios del transporte aéreo, los cuales han quedado expuestos a arbitrariedades de antiguas competidoras de Mexicana, que al encontrarse dueñas del mercado, y de los destinos específicos de esta ruina, han incurrido en toda suerte de prácticas abusivas y monopólicas. Recuérdese como en la administración pasada, caracterizada por sus políticas anti laborales y antisindicales que fueron ejecutadas de manera implacable por el ex secretario de Trabajo Javier Lozano Alarcón en contra de mineros y metalúrgicos, electricistas y los propios trabajadores de la aerolínea en dificultades, en suma fue el gobierno federal quien desencadenó el grave problema, se desentendió del problema social y económico y le apostó todo al desgaste y muerte de los afectados como una forma de extinguir el conflicto. Durante el primer año de EPN la actitud gubernamental no cambió en forma significativa con respecto a la de sus antecesores, y pese al exhorto formulado la semana pasada por el actual titular de la Secretaría de Trabajo y de Previsión Social, Alfonso Navarrete Prida, para que se resuelva de una vez por todas el concurso mercantil, miles de trabajadores de Mexicana, jubilados o no siguen sin poder hacer efectivas las percepciones y prestaciones que les corresponden, toda vez que nunca se ha declarado extinta la relación laboral entre la empresa y sus empleados. Son ocho mil trabajadores afectados por el conflicto Integrantes del comité técnico del Fideicomiso de Mexicana de Aviación, presentaron ayer su renuncia, luego de que lo exigieran trabajadores jubilados de la aerolínea. A partir de este viernes (7/2/14), la nueva administración del fideicomiso de más de 75 millones de pesos estará a cargo de trabajadores en retiro de Mexicana, a quienes la empresa les proporcionará la información disponible, infraestructura y asesoría que requieran relacionada con el fideicomiso F/797 para el desempeño de sus responsabilidades, por lo que designará a una o varias personas. El acuerdo se concretó luego de que ambas partes sostuvieron una mesa de negociación de más de cinco horas y en la que se abordó la liberación de los recursos del pago de pensiones para los trabajadores en retiro. Desde las 5 de la mañana los jubilados de Mexicana, acompañados por integrantes del Barzón Popular, bloquearon los accesos principales y el estacionamiento de la torre que perteneció a la línea aérea, ubicada en la avenida Xola, en la colonia del Valle, para impedir el paso a los trabajadores. Los inconformes también colocaron en las ventanas cartulinas y pancartas con consignas, además de un ataúd negro en la puerta principal del edificio en señal de duelo por el aterrizaje forzado de Mexicana, que lleva tres años y medio inactiva. En el encuentro al que asistió el dirigente del Barzón Popular Crecencio Morales Ávila como testigo, se firmó una minuta. En el documento las 13 personas que forman parte del comité técnico presentan su renuncia con carácter de irrevocable, la cual entregaron al administrador-conciliador Gerardo Badín y a la fiduciaria. También se asentó la designación de los nuevos miembros de comité técnico conformado por ocho trabajadores jubilados de Mexicana. “Este es un día histórico para los trabajadores jubilados de Mexicana en virtud de que hemos recuperado nuestro fideicomiso que estaba secuestrado por la empresa, que en todo momento se negaba a pagar nuestras pensiones y a transparentar los movimientos. Lo que estamos obteniendo con el apoyo de este movimiento popular es que recobramos este fideicomiso. La empresa se comprometió a entregarnos toda la documentación necesaria para hacer una auditoría, a efecto de identificar a los presuntos responsables de los malos manejos o el nulo fondo del mismo”, manifestó Fausto Guerrero Díaz, presidente de la Asociación de Jubilados, trabajadores y ex trabajadores de Mexicana, quien quedó al frente del nuevo comité. Esos dineros no fueron tocados La Compañía Mexicana de Aviación (CMA), informó este jueves que el dinero que se encuentra en los Fideicomisos para pensiones y jubilaciones del Personal de Mexicana no forma parte de la masa concursal de las aerolíneas y “no ha sido tocado”. Los fondos de los tres Fideicomisos para pensiones y jubilaciones del personal pilotos y sobrecargos, no han sido tocados, con excepción de los dispuesto por el comité técnico, la Secretaría de Gobernación y la Secretaría del Trabajo y Previsión Social, para el caso de los sobrecargos jubilados, dijo la Compañía en un comunicado difundido horas después de una protesta de jubilados de CMA. Explicó que en el caso del Fideicomiso para Sobrecargos y Sobrecargos jubilados, es el comité técnico, la única entidad independiente y autónoma que tiene la potestad para valorar la situación, decidir y dar la instrucción para que se utilicen los recursos que se encuentran en los fideicomisos. El comité está conformado por sobrecargos jubilados, sobrecargos integrantes del sindicato designados por la ASSA de México y empleados de la empresa. Por otra parte el grupo parlamentario del PRD en la Cámara de Diputados demandó al gobierno federal una resolución digna al conflicto que afecta a más de 8 mil trabajadores de CMA. Los legisladores Luis Manuel Arias, Eliana González, Fernando Cuéllar y Agustín Barrios Gómez, consideraron que “ni las liquidaciones ridículas que se ofrecen ni cualquier otro paliativo, resuelven los trabajadores en estado precario de desempleo. El fondo del asunto está en preservar la fuente de empleo, pero a los inversionistas implicados en particular se les obstaculiza insistentemente”. Al recibir a un grupo de desempleados de Mexicana, los legisladores consideraron que la liquidación ofrecida no resuelve el problema de fondo, pues lo relevante es preservar la fuente de trabajo. Para Begoña López, vocera de los trabajadores de CMA, el proceso en que se encuentran las negociaciones –concurso mercantil- no es claro, pues han pasado más de 30 potenciales inversionistas y hasta ahora se han frenado todos los concursos para salvar a la empresa. A final de cuentas resulta imperativo que las instancias judiciales a cargo del caso agilicen la solución; en caso contrario, el actual gobierno debe empezar a plantearse esquemas de intervención pública para garantizar los derechos de los trabajadores de CMA e incluso para hacer posible que la aerolínea vuelva a operar. El asunto es urgente, no sólo por la exasperante situación que viven muchos trabajadores, sino porque también cada día que pasa en suspensión de actividades la aerolínea ve mermado su patrimonio, y porque el mercado nacional del transporte aéreo requiere de una mayor competitividad para beneficio de los usuarios y del sector turístico. Además acusó a la empresa Televisa “el canal de las estrellas”, de editar el video en el cual el doctor José Mireles llama a deponer las armas, y ofreció una versión que puede verse en la dirección electrónica www.youtube.com/watch?v=KUK68ziRvPA. Pidió a sus seguidores aclarar “a la gente la manipulación de televisa en el video del Dr. Mireles; pretenden aplicar la de divide y vencerás; no permitan que dañen la imagen del Dr. Mireles”. Indicó que la edición de Televisa es evidente en el minuto 3:37 del video, en el cual Mireles dice: “aceptamos regresar a nuestras comunidades”, y se omite una frase en la que pone como condición para deponer las armas “detener las siete principales cabezas de los Caballeros Templarios”. En el video transmitido por el poder fáctico, el líder del CAU en Tepalcatepec dice: en “nombre de todos los coordinadores regionales de las autodefensas, nosotros lo único que queremos es que se restablezca el estado de derecho (corte de edición) no que se pierdan los poderes”. Afirma que “el consejo manifiesta que nos apegamos a las reglas señaladas hoy 13 de enero de 2014”. El mandatario estatal expresó su disposición para que en el proceso de restauración de la seguridad pública municipal se incorpore el acompañamiento ciudadano, siempre que se dé en el marco de la legalidad. Los representantes de las autodefensas se comprometieron a transmitir lo discutido a sus respectivos grupos. Comentó que se ataca el problema de la delincuencia en los municipios de Uruapan, Múgica y Apatzingán, este último considerado centro de operaciones de delincuentes, donde se establecieron las fuerzas armadas. En conferencia de prensa en Veracruz, explicó que cuando los militares se trasladaban hacia Apatzingán, se encontraron con pobladores “que seguramente no estaban bien informados de las labores que hacían el Ejército y la Policía Federal; se dio un forcejeo con un soldado y hubo un disparo en el que murió una persona.” También, “se habla de otra, se está haciendo la investigación correspondiente; seremos transparentes con la información que se dé, pero hasta ahora, es una muerte, que lamentamos profundamente y por ello queremos que no se dé este tipo de circunstancias y que la población esté plenamente informada”, dijo. Nosotros como todo el mundo estamos de acuerdo que el ejercito son militares que han sido entrenados para liquidar al enemigo no para perseguir delincuentes ni para prevenir delitos entre civiles, por lo que este suceso nos obliga a recordar los numerosos episodios de violencia y atropello contra la población que han tenido lugar en las circunstancias en las que se ha abusado de despliegues militares en regiones afectadas por el auge de la criminalidad organizada. En contraste , la respuesta gubernamental del momento actual resulta parecida a las concebidas y ejecutadas en su momento durante el sexenio pasado, y cuya inutilidad ha quedado exhibida, precisamente, por la permanencia de organizaciones delictivas y por la inseguridad prevaleciente, la que a su vez ha conformado el caldo de cultivo para la formación de los grupos de autodefensa que han debido hacerse cargo de la seguridad pública en las zonas en las que la Federación ha realizado despliegues espectaculares de fuerza pública para, después dejarlas abandonadas a su suerte. Miguel Concha, director del Centro de Derechos Humanos Fray Francisco de Vitoria, afirmó que si la sede pontificia quiere ser congruente con sus afirmaciones de que no protege a quienes han abusado sexualmente de menores de edad, permitirá que los miembros del clero enfrenten las acusaciones legales hechas por sus probables víctimas. “Como Estado Vaticano debe considerar con mucha atención estos señalamientos e informar a las autoridades civiles de lo que sepan, para que persigan y sancionen a los responsables. Ya no se está encubriendo como antes, ya se procede de otra manera y sería muy lamentable que a los altos dignatarios todavía se les protegiera”, indicó. El sacerdote dominico subrayó que desde el papado de Benedicto XVI se advirtió que no se tolerarían los casos de pederastia y que los religiosos involucrados en ese delito debían ser entregados a la justicia civil, por lo que el Vaticano debe ser congruente con esa postura. Consuelo Morales, directora de Ciudadanos en Apoyo a los Derechos Humanos, consideró que el informe de la ONU es una “oportunidad histórica” para que el Vaticano impulse un cambio en sus políticas sobre los derechos de los niños. “Hay una profunda responsabilidad ética y moral de la Iglesia, que no podemos aislar del mandato del señor Jesús. El mensaje evangélico es proteger a los sectores más vulnerables, y si ha habido errores o complicidades, es momento para dar un giro”, enfatizó la monja, formada en la congregación de Nuestra Señora. Aunque el fenómeno de la pederastia no es exclusivo del clero, apuntó Morales, la Iglesia Católica ”debe adoptar medidas para enfrentar su responsabilidad, porque es madre y líder moral. Como religiosa y seguidora de Jesús, pienso que este es una oportunidad para avanzar un poco más en la justicia y que los responsables sean tratados con dignidad, pero enfrentando lo que hicieron”, incluso en el ámbito penal. Por su parte el ex legionario José Barba comentó que lamentablemente “el Vaticano tiene entre sus estrategias el silencio, la dilación, la exculpación con distractores”. Apuntó además que la Iglesia “no quiere reconocer su responsabilidad, porque sabe el alto costo que le significaría reconocerse culpable”. Consideró que la sede pontificia dio una respuesta “taimada” a la ONU. Se desconfía del nuevo director de los legionarios José Barba, quien formó parte de los ocho ex legionarios que denunciaron a finales de los años 90 los abusos sexuales de Marcial Maciel (MM), desconfió de que la elección del nuevo director general de la Legión de Cristo, el mexicano Eduardo Robles Gil Orvañanos (RGO), se traduzca en una renovación de dicha congregación. Manifestó que lamentablemente RGO formó parte de la “antigua camada escogida personalmente por MM, y consideró que su elección”. “Más que un paso adelante, parece uno hacia atrás”. Además comentó que “de ninguna manera es un avance considerable”, pues se pone al frente de una congregación a la que se pretende renovar a una persona cercana a MM, en lugar de optar por alguien “menos contaminado” por el fundador de la Legión de Cristo, como el alemán Sylvester Heereman (SH), quien desde octubre de 2011 asumió provisionalmente la dirección de la congregación debido a los problemas de salud de Álvaro Corcuera. “Antes por lo menos esta SH un legionario que tenía cinco años de sacerdocio, entró tardíamente a la Legión y probablemente había sido de los menos contaminados” por MM, indicó Barba. Acerca de la aprobación de una nueva constitución de la legión, una de las tareas que los sacerdotes reunidos en el Capítulo general extraordinario que se realiza en el Vaticano, Barba comentó: habrá que ver si ésta “va a determinar algo diferente”, y dijo que difícilmente las “instituciones con actitudes de catacumbas” pueden tener cambios profundos. “No considero que se conviertan en una especie de nuevos franciscanos, es sumamente difícil dejar de ser lo que se es”, agregó. En cuanto al perdón que la congregación pidió por los abusos sexuales contra niños. Barba indicó que además de ser tardío, cuando les conviene “ellos administran la verdad y el engaño. Con estos antecedentes no se llegará muy lejos para dar a conocer al cardenal como cómplice de estos criminales en el extranjero. En Oaxaca, se tiene al arzobispo José Luis Botello con amplia experiencia en proteger a criminales mexicanos pertenecientes a su gremio clerical, un sacerdote que abusó de medio centenar de niños y adolescentes indígenas. ¿Podrán los mexicanos perdonar los abusos sexuales de estos criminales con sotana? Nacional Los tres muertos del operativo militar en Tierra Caliente Los grupos de defensa cívica Por: Carlos Damián 17 de Enero, 2014 Los ciudadanos desconocían, a qué iban los soldados en Michoacán México. - La policía federal (PF) asumió la tarde del martes (14/1/14) las labores de seguridad en Nueva Italia, cabecera municipal de Múgica, en coadyuvancia con los grupos de autodefensa, los cuales realizarán rondines se instalarán puntos de evasión, sin portar armas de fuego. El acuerdo se logró luego de una reunión privada de cuatro horas en el ayuntamiento, entre mandos de la PF el alcalde de Múgica, Casimiro Quezada, y representantes de los habitantes de esa demarcación. Durante el encuentro, comandantes de la PF pidieron a los pobladores que les den un voto de confianza para que sean los agentes federales quienes combatan al crimen organizado. Después del encuentro, Quezada salió a la plaza principal para informar a los ciudadanos que aguardaban en el lugar, los cuales al escuchar la noticia, lanzaron vítores y aplaudieron la decisión. Más tarde algunos usuarios de Facebook manifestaron en la página valor por Michoacan SDR, su beneplácito por el convenio alcanzado con la PF. “Hermano, estamos muy contentos porque se llegó a un acuerdo con la PF y Ejército, que van a seguir las barricadas y va haber en cada una de ellas siete de nuestros comunitarios en apoyo para ellos (…) tenemos que estar alertas al sonar las campanas de la iglesia para salir a apoyar. EB, dice que en ningún momento hubo un enfrentamiento entre el Consejo de autodefensas Unidas (CAU), y el ejército la noche del lunes (13/1/14). De acuerdo a la versión de EB, entre las 20 y 21 horas los soldados llegaron a Antúnez con la intención de desarmar a los comunitarios, pero unos 3 mil habitantes les impidieron el paso. Ante la resistencia, los militares intentaron replegar a los lugareños mediante golpes y empujones, pero fue en vano. Entonces realizaron disparos, primero al aire y después contra la gente, matando a tres personas, entre ellas a una niña de 11 años, lo que después se constató la existencia de tres fallecidos. Los pobladores instalan retenes sin portar armas Testimonios de pobladores confirmaron la versión de EB. Relataron que esperaban a los soldados a la entrada de Antúnez. Cuando llegaron, les expresaron su negativa a ser desarmados, con el argumento de que quedarían indefensos, ante la organización delictiva de los ‘Caballeros Templarios’ (CT). Los militares intentaron infructuosamente replegar a la multitud y después dispararon. EB aseguró que en ningún momento los elementos del Ejército se apoderaron de las armas de CAU y reiteró que las van a entregar hasta que el gobierno federal detenga a los principales líderes de los CT, entre ellos: la Tuta, el Chayo, el Quique Plancarte y el Tucán. Mientras tanto, el vocero de los guardias comunitarios advirtió: “seguiremos avanzando y esperamos que el gobierno entienda nuestra razón, están en riesgo nuestras vidas y las de nuestras familias”. Destacó que la lucha no ha comenzado aún, pues si bien la organización CAU tiene presencia en más de 20 municipios de la Tierra Caliente, Sierra Occidental y Costa, “Apatzingán sigue en manos de los CT y falta mucho por hacer”. “Como quiere negociar el gobierno cuando no ha detenido a ninguno de los cabecillas, las autoridades saben dónde están, pero es evidente que no los han querido detener”, apuntó el vocero de las guardias comunitarias. Por otra parte un comerciante en los portales en Apatzingán dice: “están equivocados si creen que nos dan más confianza con la presencia de federales; la gente tiene miedo, la ciudad está en crisis y así no se resolverá la situación”. El gobernador Fausto Vallejo en Morelia destacó el nombramiento del nuevo comisionado de la PF para Michoacán, el teniente coronel Carlos Manuel Salcedo Carrillo, y 11 mandos intermedios que serán enviados a las distintas regiones de la entidad para “regresar el orden y la paz pública” a los ciudadanos. Por la mañana en Apatzingán, desconocidos colocaron varias mantas en puentes peatonales en las que exigen la salida de grupos armados, ya que “Michoacán no necesita invasores”. Los mensajes no estaban firmados. Al mediodía, integrantes del crimen organizado intentaron destruir con un trascabo el puente Las Delicias, que comunica Apatzingán con Tepalcatepec, pero sólo dañaron un carril. En este contexto de violencia de confrontación, el sacerdote encargado del obispado de Apatzingán, Goyo López (GL), dijo que la ciudad vive un estado de ingobernabilidad, porque es la delincuencia organizada la que manda. El sacerdote consideró que no tiene sentido que los gobiernos federal y estatal traten de desarmar a los grupos de autodefensa cuando son ellos los que en unos meses han logrado expulsar a miembros de la organización delictiva ‘Los Caballeros Templarios”. “La presencia de policías federales aquí es como un teatro para apoyar al gobernador Fausto Vallejo”. No es suficiente la presencia ni la efectividad, opinó. “Aquí los que deciden la justicia y la forma de vida son: La Tuta, el Quique, y el Chayo, y nadie ha hecho nada”, agregó. Parte de los nombres de la organización criminal son: Arturo Plancarte Solís, Armando Gómez, Martín (la Tuta), Dionicio Loya Plancarte, Nazario Moreno González, Arturo Cruz Mendoza, Jesús Vázquez Macías (el Chicano), Nazario Morales González, quien dio origen a la doctrina de los Templarios, Humberto Zurita Reyes el operador criminal que fiscaliza a los comerciantes pidiendo 500 mil pesos y su aguinaldo de navidad, entre otros. Posteriormente los efectivos del Ejército y de la PF alrededor de las 14 horas ingresaron a las instalaciones de seguridad pública municipal de Uruapan, donde acudieron a encerrar en el cuartel a todo el personal operativo para una revisión de rutina del armamento usado. Confusión y manipulación de cifras Aunque desde un principio las fuerzas federales se han asumido como árbitros del operativo que parece una auto exculpación, los verdaderos criminales no han sido tocados y la presencia del x-gobernador parece una tragicomedia. Las versiones del Consejo de las autodefensas (CAU), aseguran que fueron alertados los criminales para que abandonaran las zonas urbanas y se refugiaran en la sierra aledaña, esperando que las fuerzas de la federación se confrontaran con el CAU y las desarmara. El objetivo central del gobierno federal era el CAU, y en ese camino estaban retirando armas, cartuchos y rifles hasta que en Antúnez se toparon con la resistencia de la población, asesinando a tres personas, lo cual presagiaba un lunes sangriento, y una masacre contra la población que se negaba a entregar sus armas y marcharse a sus casas para dejar que el gobierno cómplice, e inútil se hiciera cargo del desastre que por trece años sufren en Tierra Caliente. Pero a las dos de la madrugada del martes cambiaron las órdenes y según @valor por Michoacan, en Twitter las armas fueron devueltas a miembros del CAU que pudieron volver a instalar sus rutinas de protección. Todo esto en un teatro de farsa prolongada, donde los federales y el ejército supuestamente se retiraban y tomaban la posesión de la zona, el gobernador forzado por las circunstancias a estar en Apatzingán, y el secretario de gobernación instalado como comandante en jefe de esta obra llamada “segunda guerra en contra del narcotráfico”. La disculpa, emitida por delegados de todo el mundo reunidos en Roma para designar al nuevo director de la Legión de Cristo, se dio un día después de que un comité de Naciones Unidas emitió un crítico reporte en el que acusó a la Iglesia Católica de ignorar los abusos de sacerdotes contra niños. En un comunicado, los legionarios denunciaron “la magnitud de la maldad y el escándalo causado“ por MM (muerto en 2008), y dijeron que la congregación ya estaba preparada para dar vuelta a la página. “Queremos expresar nuestra profunda pena por el abuso contra menores seminaristas, los actos inmorales con hombres y mujeres adultos, el uso arbitrario de su autoridad y de los bienes materiales”, dijo la congregación. Durante décadas, el Vaticano descartó las acusaciones de seminaristas de que MM había abusado sexualmente de ellos, algunos cuando tenían apenas 12 años de edad. La cuestión más delicada del comunicado de diez puntos ser refiere al carisma. Tenemos que tener en claro que el carisma en el sentido religioso es una gracia, es un don especial que el Espíritu Santo dona para bien de la Iglesia. Los fundadores de las órdenes religiosas son portadoras de este carisma, que marca la misión, el estilo y la identidad de esa asociación civil. El texto legionario acusa, y se deslinda con argumentos falsos, tratando de hacer una ruptura entre el carisma y el fundador de la congregación. Pero aún convirtiéndolo en un chivo expiatorio, acusándolo de incongruente, perverso y pecador, él es capaz de fundar una comunidad religiosa, y sana. Pregunta este humilde tecleador. ¿Será posible que el diablo pueda fundar una congregación religiosa sana y fructífera? Esta pregunta es contestada desde la óptica de Benedicto XVI, entrevista que dio a Peter Seewald, contenida en el libro ‘Luz del Mundo 2010’, en la que el Papa afirmó que la figura de MM es un misterio y “una figura enigmática”, porque siendo un personaje torcido edificó una comunidad religiosa sana. Es decir, un árbol podrido que produce generosos frutos. Con esta lógica barata y corriente ya podemos iniciar la beatificación del dueño de Televisa, Azcárraga Jean, y de TV Azteca Salinas Pliego. En esta circunstancia vemos que los legionarios de Cristo se están ‘mexicanizando’ y aparentan que todo ha cambiado cuando en realidad todo sigue igual o peor.
