HRW: The unsuccessful president's strategy after six years
México. - ”The government of Mr. President has adopted measures the organized delinquency that they have caused a strong increment in the number of murders, tortures and other abuses on the part of the members of the forces of security, to combat and they only contribute to increase the chaos and fear climate that it prevails in many regions", Highlights Human Rights Watch (HRW) in the chapter Mexico of its World report 2012, presented in Cairo, Egypt. The document underlines that in the last years an alarming increment of the quantity of homicides has taken place that have largely been consequence of violent conflicts among powerful criminal organizations that compete for the control of the drug traffic and other lucrative activities."
The director of communication of HRW, Emma Daly, denounced that the forces of security in Mexico have made violations of human rights and that the military ones enjoy impunity in those cases. "We have data that demonstrate that the violence has increased hideously in Mexico in the last years and there is not a system able to judge to the military ones so that there is justice". In the director's opinion, “absolute impunity exists for the military ones" who, with the system of military justice one is never judged, what foments that “the abuses continue because there is not way some of stopping them". Among the crimes made by the armed forces they are mentioned: murders, it tortures and forced disappearances.

In agreement contrast with the referred organization, the Mexican state has lacked capacity to protect journalists, migrants, illegal aliens, activists of human rights and other vulnerable groups caught among the violence of the criminal groups and had practiced by the own forces of security. "However, Mexico has not offered protection to these vulnerable groups neither it has investigated the crimes appropriately of which have been victims". In the topic freedom of speech, the document of HRW points out that numerous journalists that have carried out investigations linked with the drug traffic have assumed a critical attitude or they have assumed an auto-censure attitude in front of the forces of security, the authorities and the drug dealers. Between 2000 and September of 2011, 74 communicators were murdered, at least eight during 2011.
It tortures and violations to human rights in the whole nation
It points that although many of the attacks against the members of the press happened last year are attributed to the organized delinquency, in some cases evidence that they point out the possible participation of public officials exists. "A progressive tendency was also observed to intimidate and to attack people that participate in social nets", it adds the organism. The authorities have not been able to investigate neither to judge crimes appropriately against the press, neither have they protected journalists that are exposed to serious risk, that which has propitiated a climate of impunity and auto - censure, HRW adds. It is sustained that the penal system doesn't offer justice to victims of crimes and violations of human rights. This deficiency responds to causes as corruption, training and enough resources, as well as to practical abusive (and corrupt) of the police.
With the previous opinion elements it is arduous to sustain that in the current government the “seed of a sure Mexico is sowing", when the lack of a politics of sensible public security and no fulfilment of the most fundamental responsibilities in the State has been translated, would rather, in a tragic crop and in the configuration of one of the most uncertain, greys stages and awaiting of the national history. El documento subraya que “en los últimos años se ha producido un incremento alarmante de la cantidad de homicidios, que en gran parte han sido consecuencia de violentas pugnas entre poderosas organizaciones delictivas que compiten por el control del narcotráfico y otras actividades lucrativas”.

Las observaciones comentadas confirman, en forma por demás desoladora, las advertencias lanzadas hace más de cinco años por distintos sectores de la sociedad organizada, la clase política y la academia: el combate a la delincuencia mediante la violencia física y la militarización de la vida pública no sólo garantiza el éxito, sino alienta peligrosamente la configuración de circunstancias de pesadilla como las que hoy, por desgracia vive el país.
Sin embargo ate la evidencia creciente de que la política de seguridad es, en su actual configuración un fracaso, el discurso oficial se muestra cada vez más ajeno a la realidad y mas extraviado en sus propios laberintos: hace unos días el presidente llamó a “poner en perspectiva” la violencia que se desarrolla en el país y pidió contrastarlas con las tasas de homicidios de naciones de Centro y Sudamérica, como si las muertes pudieran reducirse a meros indicadores estadísticos. El encargado de la Secretaría de Gobernación, Alejandro Poiré, ha venido insistiendo en que México “no está en guerra”, pues “no se configura ninguno de los supuestos que derechos internacionales establecen para considerar un conflicto armado”, acaso sin recordar que el primero en emplear ese concepto para referirse a la confrontación entre las autoridades y los cárteles de la droga fue precisamente, el titular del Ejecutivo Federal.

A estas alturas, resulta estéril entrar en la discusión de sí lo que hay en el país es o no una guerra, y si los niveles de violencia en México son mayores o menores a los de otras naciones. Lo que nadie parece poner en duda, fuera de los responsables de la conducción política del país, es que la estrategia de Calderón de seguridad pública y combate al narcotráfico no ha logrado acercarse a sus objetivos en materia de reducción al consumo de drogas, ni al desmantelamiento de los cárteles del narcotráfico, pero en cambio, ha multiplicado la violencia y las violaciones a los derechos humanos por parte de las corporaciones policiales de todos los niveles y de las fuerzas armadas, y ha colocado a esas instituciones, que supuestamente deben garantizar la vigencia del Estado de derecho; como factores principales del quebranto de la legalidad.
Por otra parte en las seis páginas del capítulo México del Informe Mundial de HRW 2012 se apunta que periodistas, defensores de derechos humanos y migrantes son “atacados deliberadamente” por organizaciones delictivas y miembros de las fuerzas de seguridad. “Sin embargo, México no ha ofrecido protección a estos grupos vulnerables ni ha investigado adecuadamente los delitos de los cuales han sido víctimas”. En el tema libertad de expresión, el documento de HRW señala que numerosos periodistas que han realizado investigaciones vinculadas con el narcotráfico han asumido una actitud crítica o han asumido una actitud de autocensura frente a las fuerzas de seguridad, las autoridades y los narcotraficantes. Entre 2000 y septiembre de 2011 fueron asesinados 74 comunicadores, al menos ocho durante 2011.
Tortura y violaciones a derechos humanos en toda la nación
Apunta que si bien muchos de los ataques contra los miembros de la prensa ocurridos el año pasado se atribuyen a la delincuencia organizada, en algunos casos existe evidencia que señalan la posible participación de funcionarios públicos. “También se observó una tendencia progresiva a intimidar y atacar a personas que participan en redes sociales”, agrega el organismo. Las autoridades no han conseguido investigar ni juzgar adecuadamente delitos contra la prensa, ni tampoco han protegido a periodistas que están expuestos a graves riesgo, lo cual ha propiciado un clima de impunidad y autocensura, añade HRW. Se sostiene que el sistema penal no ofrece justicia a víctimas de crímenes y violaciones de derechos humanos. Esta deficiencia responde a causas como corrupción, capacitación y recursos suficientes, así como a prácticas abusivas (y corruptas) de la policía.
Con los anteriores elementos de juicio resulta arduo sostener que en el actual gobierno se esté sembrando la “semilla de un México seguro”, cuando la falta de una política de seguridad pública sensata y el incumplimiento de las responsabilidades más fundamentales del Estado se ha traducido, más bien, en una cosecha trágica y en la configuración de una de las etapas más inciertas, sombrías y desesperanzadoras de la historia nacional. Pemex Refinement's corruption
México. - Infested by the internal corruption in Petroleos Mexicanos (PEMEX, in Spanish), their subsidiary PEMEX Refinacion (PR) it is being investigated by the indifference with which behaves their sub-director Bernardo de la Garza Hesles (BGH). According to documents, him and several of their collaborators they grant contracts to companies whose owners reward their favors later on and they deposit their “tithe “in a bank bill that manages Carlos Xavier Riquelme Cacho (CXRC), particular secretary of the official. And this way, while the corruption is embedded in the company property of the State, the refineries take place to dropper.

At the beginning of year it was detected that BGH and their boss MTD presumably they were of accomplices in the signature of a contract for 42 million dollars assigned without bid to the British multinational company KBC Advanced Technologies. (Process review 1812). in spite of the secret kept during several weeks, the information came out to it floats in January, 2011, when in the subsidiary PR it remembered to project a package of “urgent” contracts that, the directive assured, they would be granted in direct form. It was never known if there was justification this irregular bid.

From September of 2010 the beneficiaries have been MTD, BGH, and some of their collaborators. They are them those that assign to the companies of their preference inflated contracts so that they execute works in the refinery Francisco I. Madero (FIM), located in the Madero City, Tamaulipas. Of the contracts an example would be the contract CO-RMAD-143/10 that BGH and collaborators granted last September 28 to the signature Constructions and Edificaciones Fenix, S. A. de C.V., for according to the specifications of the work, the restoration of the line of Transfer 54, by means of the change of supports, and pipe of 54 diameter, alignment, change of supports, maintenance and adjustment of the supports Grinell in the Mayan combined plant #3 of the refinery of FIM."
He cost of the work specified in the contract it was of 4666 thousand 666.11 dollars, more the tax to the added value. On the part of PR they signed the document Jesus Everardo Castaneda Vega, official of the Department of contracts, Jesus Guerrero Rodriguez, boss of the Department of Contracts, Servando Olvera Resendez, in charge of the office of the superintendence of Rehabilitations and Modifications, and engineer Jose Dolores Nunez, as well as contractor Alfredo Moral Vargas. On the other hand in November of 2010 BGH, it asked CXRC and EGM to interview with Carlos Murillo (CM) and EGM, manager and superintendent of the refinery FIM, respectively.
In the encounter, the particular secretary BGH asked its speakers to assign a contract to the company USA Technologies, S. A. of C. V. Pemex Refinement's corruption

January 11, 2010, in this it is found that 42 days after they concluded the works in the refinery, it seizes they deposited 3 thousand 333.33 dollars in that bill (it indexes 0001702). The following month, February 10 had a similar deposit (it indexes 0001745). Also the 19 and 28 of January and the 3 March, 2010 the benefitted managers deposited in each case 2 thousand 666.67 dollars; March 17 had another contribution of 3 thousand 333.33 dollars. The money placed in that bill overcomes the official's monthly wage that is of one thousand 721.15 dollars. While the refineries continue lowering the production the corruption inside Pemex it continues so much without control some the administrations of the PRI like those of the PAN, impel them, they overlap them, and it follows the impunity in Pemex Refinement's lands. México. - Infestada por la corrupción interna en Petróleos Mexicanos (PEMEX), su subsidiaria PEMEX Refinación (PR) está siendo investigada por la displicencia con la que se conduce su subdirector Bernardo de la Garza Hesles (BGH). Según documentos, él y varios de sus colaboradores otorgan contratos a empresas cuyos dueños retribuyen posteriormente sus favores y depositan su “diezmo” en una cuenta bancaria que maneja Carlos Xavier Riquelme Cacho (CXRC), secretario particular del funcionario. Y así, mientras la corrupción se enquista en la paraestatal, las refinerías producen a cuentagotas.
Aún cuando lo investiga la Comisión de energía de la cámara de Diputados y la Auditoría Superior de la Federación (ASF) lo tiene en la mira por presunto tráfico de influencias, BGH, subdirector de PR, sigue asignando contratos directos a las empresas de sus amigos. Los negocios benefician también a funcionarios de la subsidiaria que dirige Juan José Suárez Coppel. Entre ellos destacan CXRC, secretario particular del propio subdirector de PR; Miguel Tame Domínguez (MTD), director de PR, y los superintendentes de las refinerías de Ciudad Madero y Cadereyta, Eduardo Gaytán Moreno (EGM) y Rodolfo Castillo Bújaros, respectivamente.

Desde entonces la Comisión de Energía de la Cámara de Diputados comenzó sus indagatorias sobre esas irregularidades; hasta ahora, sin embargo, no ha presentado resultados. Lo mismo hizo la ASF, y en fechas reciente se integró un acta circunstanciada en la Procuraduría General de la República (PGR), en torno a este caso de corrupción que implica a los funcionarios de PR. Durante la administración de Vicente Fox esta subsidiaria estuvo envuelta en escándalos por los contratos multimillonarios asignados las empresas representadas por los hijos de Martha Sahagún, la esposa del ex presidente vaquero.

Son ellos los que asignan a las empresas de su preferencia contratos “inflados” para que ejecuten trabajos en la refinería Francisco I. Madero (FIM), ubicada en la Ciudad de Madero, Tamaulipas. De los contratos un ejemplo sería el contrato CO-RMAD-143/10 que BGH y colaboradores otorgaron el 28 de septiembre último a la firma Construcciones y Edificaciones Fénix, S.A. de C.V., para según las especificaciones de la obra, “la restauración de la línea de Transfer de 54, mediante el cambio de soportes, y tubería de 54 diámetro, alineación, cambio de soportes, mantenimiento y ajuste de los soportes Grinell en la planta combinada Maya No 3 de la refinería de FIM”.
El monto de la obra estipulada en el contrato fue de 6 millones 999 mil 991.61 pesos, más el impuesto al valor agregado. Por parte de PR firmaron el documento Jesús Everardo Castañeda Vega, funcionario del Departamento de contratos, Jesús Guerrero Rodríguez, jefe del Departamento de Contratos, Servando Olvera Reséndez, encargado del despacho de la superintendencia de Rehabilitaciones y Modificaciones, y el ingeniero José Dolores Núñez, así como el contratista Alfredo Vargas Morales. Por otra parte en noviembre de 2010 BGH, pidió a CXRC y EGM entrevistarse con Carlos Murillo (CM) y EGM, gerente y superintendente de la refinería FIM, respectivamente.

La obra concesionada a la compañía estadounidense tenía como propósito la “restauración de la línea transfer P3215 de 54 del H10002b hacia la torre T-10006 (sección de vacio) mediante el cambio de codos y tubería de 54 diámetro, alineación, cambio de soporte, mantenimiento y ajuste de los soportes Grinell, en la planta combinada Maya de la refinería FIM, en Cd. Madero Tamps.

La diferencia estriba en que el monto del contrato fue de 15 millones de pesos. Fuentes consultadas aseguran que BGH instruyó también a CM y a EGM para que inflaran la cantidad al triple 45 millones de pesos. De acuerdo con denuncias de los trabajadores de la refinería FIM. “aún existen tuberías que fueron suministradas por el contratista y que permanecen guardadas en los almacenes de Pemex, ya que no se requerían para realizar dichos trabajos”. Esas maniobras le han redituado ganancias millonarias a BGH y a sus colaboradores. Un trabajador al ser entrevistado entregó una serie de documentos en los cuales había estados de cuentas bancarias y movimientos de dinero de CXRC que al parecer corresponden a los pagos mensuales realizados por la subsidiaria de Pemex a las empresas beneficiadas por BGH.

El 11 de enero, 2010, en este se encuentra que 42 días después de que concluyeran los trabajos en la refinería, así depositaron 50 mil pesos en esa cuenta (referencia 0001702). Al mes siguiente, el 10 de febrero hubo un depósito similar (referencia 0001745). Además el 19 y 28 de enero y el 3 marzo, 2010 los empresarios beneficiados depositaron en cada caso 40 mil pesos; el 17 de marzo hubo otro aporte de 50 mil pesos. El dinero colocado en esa cuenta supera el salario mensual del funcionario que es de 25 mil pesos 817.33 pesos. Mientras que las refinerías continúan bajando la producción la corrupción dentro de Pemex sigue sin freno alguno tanto las administraciones del PRI como las del PAN, las impulsan, las solapan, y sigue la impunidad en los terrenos de Pemex Refinación. Padre Pato: La emergencia alimentaria en la sierra tarahumara es recurrente
México. - Es dramático, sin embargo el rumor resultó en parte cierto (6 muertos) y logró poner a la vista de todos una verdad que la mayoría conoce pero había olvidado a un sector de la población en miseria extrema: los pueblos indígenas de México, los tarahumaras (rarámuris) de Chihuahua entre ellos, viven una hambruna crónica. Aunque muchos prefieren no verlo, pero esperan verlos con sus ojos como moscas fumigadas para poder hacerlo, pero hay demasiadas evidencias de ello, como la imposibilidad de acceder a las tres comidas diarias por falta de ingresos económicos, desnutrición crónica por la mala calidad de la comida que ingieren, crónicas enfermedades que ya se creían superadas, derivadas de la desnutrición y falta de higiene.
Son datos que resaltan siempre que algún personaje público quiere medrar con ellos, o para alarmarlos a todos como si fuera un caso excepcional, pero ahí han estado siempre. En el tiempo que fuera presidente Vicente Fox éste declaró a Coycoyán de las Flores, en el estado de Oaxaca, del municipio más pobre del país. Se dijeron muchos discursos sobre la situación, pero nada en concreto se hizo por ayudarlos a salir de la pobreza; otro tanto sucedió después con los municipios s de Metlatònoc y Cochoapa El Grande en el estado de Guerrero, también de población mayoritaria mixteca.
Un herencia de resistencia histórica para no morir
La novedad ahora son los tarahumara y el mundo está viendo como están sufriendo la hambruna, la miseria, pero en esta situación pueden estar los nahuas de Veracruz, los tzetzales de Chiapas, los mayos de Sinaloa, o cualquier otro pueblo indígena de México. Todos ellos viven en la misma condición de pobreza, marginalidad, abandono, aislamiento, rechazo cultural y discriminación racial. Sobreviviendo como pueden y resistiendo para no desaparecer por inanición. Lo anterior no se necesita comprobarlo es cuestión de volver atrás en el tiempo. A inicios del año 2011, el ‘Consejo Nacional para la Evaluación de la Política Social (Coneval) presentó su informe de la evaluación de la política de desarrollo social en México, 2011’, con un apartado especial sobre la política de desarrollo y los pueblos indígenas.
El informe es breve y contundente, el informe asienta que ocho de cada diez indígenas en México (79%), se encuentran en situación de pobreza, lo cual quiere decir que no pueden satisfacer sus necesidades inmediatas: alimentación, salud y educación. También se afirma que 40 por ciento de ese porcentaje a reconocer que no cuentan con ingresos para satisfacer sus necesidades. La situación es dramática. De todo esto nada ha servido que México haya firmado el Convenio 169 de la Organización Internacional del Trabajo (OIT), sobre derechos de los pueblos indígenas, realizadas hace 20 años; ni la reforma al artículo 2 constitucional de agosto de 2011, donde supuestamente se reconoció la autonomía de los pueblos indígenas y su derecho a decidir su propio desarrollo.

Es digno de destacarse que el pueblo mexicano tiene derecho a la alimentación, educación, salud, al trabajo, a la vivienda y a un medioambiente limpio., pero la situación es diferente ya que el Estado no cumple con sus obligaciones de garantizar, promover y respetar los derechos humanos, sigue privilegiando los intereses empresariales frente a las garantías básicas de las personas. Esto se presenta disfrazando de proyectos infraestructuras y supuesto progreso, se ha dado paso a grandes trasnacionales de la minería, la alimentación y la construcción.

Situación de emergencia nacional
Esta situación de emergencia, debe obligar al pueblo mexicano para atender la urgencia alimentaria sino para revisar a fondo las estrategias y políticas sociales, y la situación del campo mexicano por parte de los tres niveles de gobierno, y en especial, por parte del gobierno federal que es el que elabora las políticas nacionales. Desde hace más de 75 años que no habíamos tenido una situación tan grave como la que se está registrando actualmente por sequía, hambruna, inundaciones, helada y en general por el cambio en las condiciones climáticas. Se tiene que después de 20 años de luchas sociales se reconoció el derecho a la alimentación en la Carta Magna. El 13 de octubre de 2011 se publicó en el Diario Oficial de la Federación, la adición de un párrafo tercero al artículo 4, y un segundo párrafo de la fracción XX del artículo 27.
Se destina una gran cantidad de recursos económicos al agro mexicano con resultados deficientes, pues no se ha incrementado la productividad. Los programas se han vuelto peligrosamente asistenciales, destinados a crear beneficios sociales sin llevar aparejada la necesaria generación de capacidades. Sólo 17 % de los recursos del programa Especial Concurrente se destinan al desarrollo rural; ello es insuficiente para solucionar problemas como la falta de infraestructura, la concentración de tierra por grandes empresas agroindustriales, así como práctica de comercialización ventajosa para intermediarios en detrimento de pequeños productores.
Por eso hasta nuestros días las poblaciones indígenas de Baqueachi y Choreachi siguen defendiendo sus tierras en los tribunales agrarios. Pero no es el único despojo que sufren los indígenas: la irracional explotación forestal que en nada los beneficia, ahora se une la explotación minera -que este sexenio ha sembrado a todo lo largo de la nación mexicana-, y el proyecto turístico ‘Barranca del cobre’ de los cuales ellos ven correr la contaminación y la basura que van dejando estos depredadores extranjeros. Esta miseria no acaba porque nos desgarramos las vestiduras, sino cambiando la relación de colonialismo y la relación que hay entre la sociedad como colectivo social-económico, por otra parte son pueblos que pueden diseñar su propio desarrollo, y por último aceptar su autonomía como organismo colectivo social, y reconocer los acuerdos de San Andrés que hace 15 años no se han cumplido. Algunos voceros de estas personas que están haciendo el negocio de su vida, dicen que es absurdo lo que propone el candidato de la línea progresista, porque resulta más barato comprar la gasolina en el extranjero que producirla en el país, cuando desde luego esa propuesta no tiene ni pies ni cabeza.
Se tiene que defender y darle valor a la materia prima, nada más es cosa de tener a la vista lo que está haciendo Estados Unidos que tiene 144 refinerías; países como Japón que no tiene petróleo, casi 50, y nosotros tenemos seis refinerías, y desde hace 30 años no se construye una nueva refinería. Todo porque resulta mejor el negocio de la compra de gasolina en el extranjero. Indicó que esto abarca 51 por ciento del combustible que se consume en México, lo que representa un gasto alrededor de 26 mil millones de dólares. Tan sólo el flete de 50 mil barriles diarios “nos cuesta a razón de tres pesos por litro”, es decir, 80 mil millones de pesos al año, recursos que alcanzan, para construir una refinería más grandes que las anteriores.

Un castigo a los bolsillos de los ciudadanos mexicanos sin sentido, al contrario de la burocracia mexicana de alto nivel se vuelve aún más rica cada vez que pasan seis años de administración federal.

El déficit de la refinería de Cadereyta es de 85 mil barriles diarios. Si se lograba concretar la producción planteada a principios de junio, las medidas seguirían trastornando el Sistema Nacional de Refinación (SNR), pues entre otras cosas se preveía que ante el aumento productivo de la refinería de Cadereyta de desahogara el poliducto que la conecta con la de la refinería de Madero, que está actualmente saturada. Por su parte la refinería de Madero tendría que apoyar el abasto en el Bajío, donde los inventarios de combustible bajaron por el paro de Cadereyta.
Los paros irregulares de las refinerías no han contado con la supervisión de ningún órgano interno de control, por lo que no hay ningún proceso abierto contra los responsables, aunque no sólo impacta en las finanzas sino en la operación total del SNR. La única medida adoptada por Pref fue remover al jefe de Unidad de Producción de Cadereyta, Guillermo Trujillo Rendón, y designar en el cargo a Roberto Mendoza Díaz para que se encargue de la recuperación de las operaciones.

No obstante, en los reportes internos se asentó que el supuesto percance fue por una “falla en el cambiador de calor y calentador” de las plantas primarias I, sector hidros II y planta catalítica, por lo que dichas instalaciones dejaron de operar. Los documentos establecen también que el problema pudo surgir por la fractura de un tubo. Aunque Miguel García Conde, director de protección civil de Hidalgo declaró que por negligencia ocurrieron los incidentes en la refinería Miguel Hidalgo, lo que podría poner en riesgo a la población, Pemex no hizo comentarios.
De acuerdo a lo anterior no hay ningún razonamiento congruente y coherente para no hacer refinerías en el país que como México vende petróleo por ser productor al mundo. De acuerdo al líder de la línea progresista de los candidatos presidenciales, construir las cinco refinerías que se propone, significaría crear empleos y ahorrarnos mucho dinero; quitar muchos subsidios que no van al consumidor, sino a los encargados de la compra de la gasolina y diesel. ¿Quiénes son los rateros?, es un secreto muy bien guardado, porque es uno de los grandes negocios que se hacen desde la cúpula del gobierno. Todos estos grandes negocios son sin meter ninguna inversión particular porque se están haciendo con el petróleo del pueblo mexicano. Aunque al reducir el precio de estos energéticos sería apoyar al consumidor y sostener económicamente a la pequeña y mediana empresa. Los legisladores a favor de los gasolinazos
México. - A pesar de su baja productividad, que tiene en la congeladora más de 2 mil iniciativas, las comisiones ordinarias en la Cámara de Diputados se tomaron un mes de vacaciones, desde que terminó el período de sesiones. La primera en citar a reunión, para el 10 de enero, es la comisión de seguridad social, que sólo ha aprobado 20 de las 106 iniciativas que le han sido turnadas en dos años y medio de la actual legislatura.
Aun cuando los presidentes de las comisiones cuentan con un presupuesto adicional de 35 mil pesos al mes, así como un auto con chofer y derecho a dos asesores, hay quienes no han convocado a una sola sesión de trabajo y no han votado una iniciativa en dos años y medio de trabajo. Entre estas resaltan los casos de Luis Felipe Eguía (LFE) del PRD, y Octavio Pedroza (OP) y Kenia López, ambos del PAN. LFE es quien preside la comisión de Fomento Cooperativo, y en el período ordinario sólo asistió a siete sesiones, y que en contraste con la inactividad del órgano legislativo a su cargo, ha presentado 31 iniciativas.

Pedroza (OP), quien salió de una empresa fabricante de mazapanes a las filas del PAN, reside la de fortalecimiento al Federalismo, la cual no ha dictaminado ninguna de las seis iniciativas que ha recibido. Y la Comisión de cultura, de la que es presidenta Kenia López, sigue sin dictaminar 13 de los proyectos recibidos. Sin embargo la Comisión de Hacienda es la que más rezagos tiene, dirigida por, Mario Alberto Becerra Pocoroba (MAPB) del PAN, en la que esperan aún ser dictaminadas 549 iniciativas. Dicha comisión sólo ha votado 31 y desechado seis.
De acuerdo con el nuevo reglamento de la Cámara de Diputados, las iniciativas que no sean dictaminadas en un plazo máximo de 45 días prorrogables por un lapso igual, deberán ser enviadas al pleno para que éste determine si las rechaza o las aprueba. Diariamente en la gaceta parlamentaria se publican exhortos dirigidos a APB para que a su vez cite a la Comisión y desahogue los pendientes, pero el ex rector de la Escuela Libre de Derecho y abogado fiscalista no los atiende.

La Procuraduría general de la República exculpó a todos los involucrados en el famoso Pemexgate de los delitos de lavado de dinero y delincuencia organizada, los más que se les pudo haber acusado y que de tipificarse habría significado varios años de prisión. Solo quedó pendiente de resolver la averiguación previa por delitos electorales anunciaban los medios a fines de julio de 2003. Los recursos económicos del erario nacional dedicados a universidades privadas
México. - Son tiempos de mercaderes, los neoliberales continúan con su espectáculo de chivos en cristalería. Tal vez el actual podrido carcinoma que corroe al capitalismo haya puesto a pensar a algunos, pero son muy pocos. Los neoliberales no piensan, se alimentan, no del conocimiento del mundo, sino de un dogmatismo puro. El presidente Calderón anunció el pasado mes de enero que gobierno y particulares van a comenzar a vender educación superior, ahora sí va en serio.
Por lo pronto se entregarán recursos económicos que son de la sociedad mexicana, a 21 universidades privadas; los planteles privados son: el Instituto Tecnológico de Estudios Superiores de Monterrey (ITESM), la Universidad de Monterrey (UDEM), Regiomontana (UR), Anáhuac México (UA), Latinoamericana (UL), Panamericana (UP), Tecnológica (UT), Popular Autónoma del Estado de Puebla (UPAEP), Jesuita de Guadalajara (ITESO), Claustro de Sor Juana (UCSJ), Justo Sierra (UJS), Latina (UL), Intercontinental (UI), del Valle de Atemajac (UVM), Tangamanga y Contemporánea (UTC), y el Centro de Enseñanza Técnica y Superior (Cetys). De las anteriores escuelas la pregunta es, ¿a cuál de ellas puede llamarse universidad?
Hipotecar a los egresados
El señor Calderón anunció el inicio del Programa Nacional de Financiamiento a la Educación Superior, con participación de seis bancos comerciales y 18 planteles de educación superior privada, además del gobierno federal por medio de Nacional Financiera (Nafin) y de la Secretaría de Hacienda y Crédito Público (SHCP) A través de este instrumento se pretende otorgar crédito a estudiantes de licenciatura, ingeniería y posgrado –hasta 215 mil y 280 mil pesos, respectivamente- a un plazo de 15 años y medio con una tasa de interés fija de 10 por ciento.
Circunstancialmente el anuncio tuvo como telón de fondo la protesta de estudiantes del ITESM, fuera del recinto por la violencia en la nación mexicana. Más allá de la insensibilidad coyuntural referida, el anuncio del programa de créditos educativos revela hasta qué punto ha llegado el gobierno federal en su empeño por privatizar la enseñanza superior y cuánto es su desdén hacia las universidades públicas del país. Los establecimientos privados, dice el presidente, otorgan “educación superior de calidad”, “buenas carreras” y una “sólida formación profesional” y “personal altamente calificado”. Pero el agravio a la enseñanza superior pública no es sólo de palabra, sino también de acción, por cuanto el gobierno federal se muestra más empeñado en promover, publicitar e impulsar –incluso con recursos del erario- los centros universitarios privados que en mejorar presupuestos de las universidades públicas.
En efecto: ignorando la concepción de la educación como responsabilidad del estado y de la sociedad para con todos sus integrantes, la administración federal busca multiplicar con este programa la clientela de dos clases de instituciones privadas: las bancarias y las universitarias. Es una forma paradójica de promover “una sociedad más cohesionada, más igualitaria y más solidaria”, cuando se parte de la idea de que la enseñanza superior se ofrecen los establecimientos privados es “mejor” y se limita implícitamente el derecho a la educación a quienes resulten sujetos de crédito, falso remedo de la educación en Estados Unidos.

La abdicación del estado a su responsabilidad de garantizar la enseñanza superior universal, gratuita y de calidad, y la imposición del modelo de educación universitaria a crédito, no sólo convierten la actividad universitaria en un ramo comercial más, sino arrojan año con año a millares de egresados que empiezan su vida laboral con una pesada deuda a cuestas, lo que se asemeja mucho a una larga e inaceptable confiscación salarial. Significativamente, uno de los señalamientos de los estudiantes movilizados es su aspiración a disponer de una educación superior gratuita “como en México”.
Las carreras que supuestamente estudian en establecimientos privados son: derecho, mercadotécnica, cómputo, psicología, etc. Áreas en las cuales los egresados universitarios de acuerdo a ANUIES (2000), el 50% de los profesionistas no hallaban un empleo de acuerdo a lo que estudiaron, lo que los llevaba a otro segmento de mercado con menores ingresos, desplazando a otros y así en cadena descendente. Las profesiones que se imparten en universidades privadas, son: porque los mercados laborales de estas “profesiones” están saturados, y porque la calidad de los egresados no cubría los requerimientos que las empresas requieren actualmente.
Por las razones expuestas, no se debe permitir el desarrollo y la consolidación en el país de esta concepción mercantil de la educación superior. Esta nueva manera de minimizar y desvirtuar la enseñanza superior pública y de impulsar lo que no es sino un negocio bancario y de escuelas privadas, hipotecará el futuro de muchos jóvenes universitarios. Now although the investigation of the CNDH heads to determine that the shots came from the ministerial agents, it doesn't exempt it to the PF of responsibility in these facts: finally of the history, that corporation has, among other functions, the one of watching over the freeway piece in that it happened the referred tragedy; in consequence, if their troops didn't carry out the shots that removed the life to the two students and they hurt to several more, it is necessary to attribute them, at least, responsibility for omission, because they should have avoided the lethal aggressions, against the demonstrators.

Given the nature of these reproof events, and their delicate consequences for the tranquillity of the social coexistence, the organizations of human rights propose that in their resolutely CNDH it assumes the non repetition measures that the Inter-American Commission of human rights points out literally in the paragraph 66 of its Report on the situation of the defenders of the human rights in America. In the preliminary report of the CNDH it already determined that it lost temper the scenario of the facts, and that the excessive and disproportionate use of the public force was the direct cause of the death of three people, of four wounded for firearm projectile and of 14 students victims of cruel treatment, generating with it direct 29 victims and two insinuations. However it is necessary that it clears up the responsibility that fits to each one of the police bodies that in they entered it, urging for that all the information that requires, and making storing of all the tests, the testimonies and the expert verdicts that it needs.
The document of the CNDH will be able to help to clarify and to delimit responsibilities about who one shoot against the students, but the fact that those deaths have taken place in the context of a student protest it throws light to a circumstance more than bottom and worry event: the persistence in the criminalization of the social dissents that increase in the national territory, that which, joined to the indolence of the authorities of all the levels to assist demands of sectors unsatisfied, it configures an explosive mixture and, like it can it turns, even human.
In the immediate thing, it is necessary to demand that the results of the investigation carried out by the CNDH, once presented in their final version or even before, have echo in the procurement instances and impartation of corresponding justice, so that it is sanctioned to the responsible ones and the damage is repaired to the families of you kill them. But from a perspective more general situations like the one happened in the Freeway of el Sol the past 12 of December will be able to repeat in the measure in that the governments of the different levels follow without completing with the elementary responsibilities: to assist and to give bed to the population's demands and to preserve the life the integrity of people.
