Bajo esta falsa premisa de crear empleos y la urgente necesidad de flexibilizar la Ley Federal del Trabajo (LFT), para adecuarlo a las nuevas relaciones laborales internacionales, se ha construido un golpe fuerte contra la clase social que ha levantado a este país y que la nueva clase política odia con un rencor pocas veces visto. Así es como vemos la reforma hecha a la medida del empresario y un proyecto de deja intocable al sindicalismo corporativista de viejo cuño, anulando al mismo tiempo muchos derechos de los trabajadores. Los trabajadores y empleados de este naciòn que sustentan al país con sus impuestos, sólo piden una cama para descansar, un salario que sustente a su familia y nos de tiempo para descansar de las labores diarias del trabajo duro. En esta circunstancia es dado recordar que una iniciativa para reformar la LFT fue presentada hace poco más de dos años por Felipe Calderón (FC), la llamada Ley Lozano, que fue rechazada al no lograr “consensos” políticos. Después sin previo aviso, el PRI presentó la suya; pero con un contenido mucho mas atentatorio contra los derechos de los trabajadores. Pero no fue votada a favor porque a CTM del Estado de México se opuso, con la amenaza que ellos no votarían por Enrique Peña Nieto (EPN), sin embargo poco después votaron por la silla presidencial y ahora están arrepintiéndose. Tratan de ahogar toda esperanza económica Cómo ambas iniciativas lesivas y gravosas para el trabajador fueron muertas y sepultadas sin embargo, fueron sorpresivamente revividas para susto y explotación de los trabajadores, por medio de un decreto del presidente en turno FCH. En este contexto es evidente que el PRI quiere allanarle el camino a EPN con una reforma que puede desgastarlo si no se aprueba antes del primero de diciembre. Por esta razón se ha prestado el gobierno de Calderón, corrupto e impune ante sus fechorías, para pagar al costo político que sea. Darle el apoyo al nuevo gobierno para agradecerle de esta forma a quienes impusieron el actual régimen y apenas salir con una imagen rota y un mal prestigio. Esta reforma es el pago al empresariado y a la derecha por su apoyo, al inscribirse en los criterios neoliberales que impone el Fondo Monetario Internacional y el Banco Mundial, además de otros organismos internacionales que han ayudado a mantener el establishment. Esta reforma tiene la intención de aniquilar cualquier forma de autonomía sindical, destrozar el valor adquisitivo del salario, aumentar los índices de pobreza del mexicano, y ahogar toda esperanza de subir en la clase social trabajadora. Probablemente el acuerdo será en beneficio de los trabajadores impulsada por los patrones, y que “quede claro que la reforma fue consensuada” entre los “representantes populares” (eufemismo para no mencionar a CANACO, CANACINTRA, y COPARMEX). Desde luego la unanimidad no existe en ninguna parte, nos dirá la triunfante bancada del PRI, apoyada por el PAN, y nada tendría de raro que también lo fuera por algunas agrupaciones de “izquierda” del PRD. Pero con esta reforma el perro traerá una larga cola sucia, con mucha facilidad para despedir asalariados, aumentos en la edad de jubilación, disminución de los tiempos del pago por seguro de desempleo. Hoy como nunca el sindicalismo se halla reblandecido por el desempleo, el subempleo, y el inmenso mundo de la economía informal. Probablemente alguna que otra agrupación tendrán su espacio para el pataleo, pero hasta ahí llegarán las cosas. La “reforma” es aprobada a la mayor brevedad. Desmontar el estado de bienestar en Europa ha demandado diversas “reformas” que se operan mediante un mismo instrumento: la cuchilla del cadalso. Así, todas la llamadas “conquistas históricas” que conformaban el estado de bienestar, si antes no ocurre otra cosa irán a dar al patíbulo. Los empleos provienen de la inversión, y ésta ocurre si existen claras expectativas de ganancias, no es una receta mágica, ni obligatorio que al flexibilizar los despidos este país va a ser mejor, y más rentable. Es una gran mentira como tantas otras recetas neoliberales nos tratan de dormir otra vez, hipnotizándonos. Si hay expectativas de ganancia, es porque hay mercados internos y externos que pueden consumir, pero éste no es el caso; la economía mundial ha entrado en altas y pronunciadas bajas, tiende al estancamiento; de manera que vincular inmediatamente la flexibilidad de los despidos con una mayor creación de empleos es un cuento clásico empresarial y político. La reforma labora ha operado prácticamente en toda Europa con modalidades diversas según la historia laboral y económica de cada uno de ellos, y es claro que el tema central es el despido de trabajadores a cualquier día y en cualquier hora. La Fundación primero de mayo española, nos dice en un informe: “El despido es más que un acto económico, pero se intenta que se interiorice la idea de que se trata de un fenómeno socialmente banal, e irrelevante que no genera daños a nadie. Esta idea de ampliar las causas del despido que abarata al trabajador, se machaca constantemente hasta el cansancio por el establishment. Se tiene la idea que al flexibilizar y abaratar el despido se justifica con la tonta razón que tenemos que quitarle el miedo al empresario a contratar trabajadores, y de esta manera el despido es más barato y fácil. Sin embargo hay diversos consensos internacionales que demuestran que no existe ninguna relación clara entre el nivel de protección contra el despido y la situación del mercado del trabajo. Nacional El vencedor sin legitimidad Ellos han vencido sin convencer Por: Carlos Damián 1 de Septiembre, 2012 Es un tribunal que vive en el pasado, debido al carro completo del PRI México. – Con las resoluciones del Tribunal Electoral del Poder Judicial de la Federación (TEPJF), que certifican la validez de los comicios del pasado primero de julio y que declara presidente electo a Enrique Peña Nieto (EPN), culmina formalmente el proceso electoral. Tal desenlace, sin embargo no resuelve la disputa por el proyecto de país que viene dirimiéndose desde hace más de dos décadas y ni siquiera es seguro que logre mantenerla dentro de las vías institucionales, habida cuenta que, para un importante sector de la sociedad el triunfo del priísta fue consecuencia de graves irregularidades. Los mecanismos de la democracia representativa y las instituciones encargadas de ponerlos en práctica tienen como propósito superar las diferencias entre sectores políticos y generar acuerdos sociales a partir de la conformación de una mayoría de electores, ya sea simple o absoluta. En torno a una candidatura que, sobre esa base, ejercerá un mandato por un tiempo determinado. Para ello se requiere no sólo del consenso sobre las reglas del juego, sino también de condiciones de legalidad, transparencia y plena libertad que susciten confianza en los organismos electorales y certidumbre en los resultados. No fue eso por desgracia, lo que ocurrió en los pasados comicios, cuando se puso en juego, una vez más, la permanencia o el cambio del modelo político-económico impuesto en el país desde el sexenio de Miguel de la Madrid, ahondado durante el de Carlos Salinas de Gortari y continuado por las siguientes tres administraciones. De entrada, la credibilidad de organismos y procesos electorales se encontraba minada de antemano por las graves irregularidades ocurridas en 2006, cuando el gobierno federal, los medios electrónicos privados, las cúpulas empresariales y el propio Instituto Federal Electoral (IFE) operaron a favor de Felipe Calderón, en contraste de las leyes y las normas vigentes. Además en esta ocasión la candidatura presidencial del PRI venia lastrada por señalamientos del favoritismo del duopolio televisivo, y por los problemas de imagen del tricolor. A mediados de mayo estos aspectos negativos se convirtieron en muestras masivas de rechazo social en contra del político del Edomex. En tal contexto, la única forma en que el PRI pudiera hacerse con la Presidencia sin generar impugnaciones ni ahondar la fractura social habría sido mediante un escrupuloso respeto a la normativa electoral, el deslinde respecto de su pasado autoritario y la distancia de sus elementos más identificados con la corrupción y el abuso. Por el contrario, la campaña del PRI fue un constante refrendo de los aspectos más irritantes del anterior partido único. Para colmo, desde días antes de la elección fue ostensible el recurso de prácticas indebidas empezando por la coacción del sufragio, la cual fue realizada a la vista de la sociedad. En semanas siguientes, la coalición Movimiento Progresista acumuló miles de pruebas sobre esa práctica, y más grave aun, sobre los manejos oscuros de grandes sumas de dinero y sobre triangulaciones monetarias realizadas por operadores de la campaña del tricolor. El hecho de que el TEPJF haya declarado, sin más trámite, la inexistencia jurídica de tales irregularidades, no basta para desvanecer la convicción de cuando menos un tercio del electorado ni para disipar su renovada irritación ante lo que es visto ahora como una nueva imposición. Así pues, el manejo del proceso electoral de este año, lejos de superar la fractura generada por el de 2006, la ha profundizado y ha colocado al país ante un nuevo divorcio entre la formalidad de las representaciones políticas y sectores sociales que no están dispuestos a reconocer a las autoridades emanadas de los comicios. La elección pervertida En este libro negro, elecciones 2012, de 48 páginas, autor Ricardo Monreal del Movimiento Progresista (MP), y su compilador es Francisco Estrada (Secretario técnico del MP), al tomar la etapa de lucha de AMLO y el MP las vías jurídicas para impugnar una elección sucia y comprada, de Julio Boltvinik, nos dice: “La pasada elección presidencial estuvo muy alejada de la equidad democrática. El dinero a raudales, de procedencia desconocida y al margen de toda justificación, se convirtió en esta ocasión en una partícula del fraude y el abuso electoral. El dinero ilegal e ilícito es inocultable. El derroche es su principal expresión. Utilizando un símil de los juegos olímpicos, el candidato presidencial del PRI, EPN, corrió dopado bajo los efectos de una sustancia expresamente prohibida por la legislación electoral, el dinero en efectivo y en especie, cuya sobredosis afectó la naturaleza, el diseño y el desarrollo mismo de la competencia política. Por lo tanto, la carrera debe invalidarse y normas que establece la Constitución y la legislación electoral”. http://exigimosdemocracia/impugnacion-de-la-eleccion/ De esta forma, el fallo inapelable del TEPJF alimenta la irritación política y el agravio en amplios sectores, el tiempo que ahonda la fractura social ya existente, la cual , a su vez se suma a los de por sí severos y crecientes factores de inestabilidad, ingobernabilidad y violencia presentes en el panorama social; la pobreza y el desempleo, las carencias de salud, la descomposición institucional, la corrupción multiplicada y el desastre que deja la actual administración en materia de inseguridad y descontrol delictivo. La perspectiva debiera resultar preocupante para quienes aspiran a conformar, con base en una primera minoría formal, el próximo gobierno. Para el PRI se ha configurado, en suma como pocas veces le había pasado en la historia política del partido, el peor de los escenarios de triunfo: vencer sin convencer. La confirmación de una nueva administración en estas condiciones será, innecesariamente, tema obligado de reflexión en los próximos meses.. En lo inmediato, y ante las movilizaciones sociales en curso, es pertinente hacer un llamado a todos los actores políticos, pero especialmente a las autoridades, a extreman la prudencia, la contención y la sensatez. En los hechos, en México se vive una guerra de exterminio en contra del sindicalismo democrático e independiente que incluye acciones legales, violencia oficial, campañas mediáticas de criminalización y ajustes a la legislación laboral que faciliten la sobre explotación de la fuerza de trabajo. La iniciativa lesiva para los trabajadores Se emplaza al gobierno y a los poderes fácticos para que abandonen sus pretensiones de apostarle a cualquier reforma que busque el fortalecimiento del presidencialismo autoritario, que socava la pluralidad del poder legislativo y el equilibrio de poderes, y que pretenden anular las conquistas históricas de los trabajadores. Se pretende establecer contacto con los líderes de todas las fracciones parlamentarias y con los diputados y senadores de todos los partidos con el propósito de establecer una mesa de diálogo y concertación con el movimiento, y de los acuerdos que se construyan legitimarlos a través de una consulta popular. A partir de este diálogo público, plural y transparente, construir un acuerdo político de cooperación con los partidos y legisladores, en la perspectiva de impulsar una agenda legislativa para contener las reformas estructurales neoliberales e impulsar los cambios que le abran paso al desarrollo social, sostenible y sustentable que reclaman las mayorías de nuestro país. Se buscará establecer una amplia política de alianzas con instituciones, organizaciones sociales, políticas y personalidades de todas las tendencias para promover nuestras propuestas y avanzar en la construcción del Consejo Económico y Social de Estado que dé viabilidad a un Pacto político de Concertación Nacional, con base en una agenda de gobierno y la definición de políticas públicas que se materialicen en un Plan Nacional de Desarrollo Democrático. Por lo anteriormente expuesto, se llama a reivindicar la lucha política de los ciudadanos para conformar un gran movimiento social de carácter nacional y construir un frente amplio en defensa de los derechos históricos de los trabajadores. Con este propósito se hará uso de todos los recursos políticos y de movilización social promoviendo un plan de acción que incluye todas las medidas de presión social; como la realización de plantones, marchas, mítines, foros y en un momento determinado concertar con otros sindicatos una huelga nacional.
