México.-   De acuerdo al diputado Gerardo Gaudiano Rovirosa (PRD), presidente de la Comisión de Recursos Hidráulicos de la Cámara de Diputados, en el dictamen de la reforma a la ley de aguas promovida por el Ejecutivo federal, apoyada por el PRI- PAN, y se introdujo de última hora una modificación  que va a dejar en manos de la Comisión Nacional del Agua (Conagua) la definición del porcentaje de participación privada en los proyectos de infraestructura, explotación, distribución, facturación y cobro de agua potable al usuario final, de acuerdo con un reglamento interno al que los legisladores no tienen acceso.  Tal maniobra es característica de la manera en la que han venido siendo  aprobadas las distintas reformas regresivas implantadas en lo que va de esta administración, está orientada a dotar a ala Conagua de un margen discrecional lo suficientemente amplio para llevar la privatización del líquido vital a sus últimas consecuencias, como ocurre ya en el caso de la industria eléctrica, gas y petrolífera, a raíz de la reforma energética de EPN. Aguas con Conagua Se pretende que en suma, eliminar el sentido social que priva en la legislación nacional vigente en materia de recursos hídricos para convertir su extracción, tratamiento y distribución en un negocio y dejar que sean  las lógicas de mercado las que regulen tales actividades. Si incluso con las leyes en su forma actual existe inequidad manifiesta en el acceso de las personas al agua, la reforma en curso agudizaría, tal desigualdad y sería en los hechos, nugatoria del precepto constitucional en el que se establece que “toda persona tiene derecho al agua para consumo personal y doméstico en forma suficiente, salubre, aceptable y asequible” (Artículo 4º), y en contra de las disposiciones de la OMS donde manifiesta el consumo del ciudadano a 100 litros. Por añadidura, la adulteración legal que se pretende imponer dejaría en la indefensión a estados, municipios y comunidades en el manejo de los recursos hídricos para favorecer a consorcios privados nacionales y extranjeros, no sólo dedicados al manejo de aguas, sino también a empresas petroleras, por ejemplo, la extracción de hidrocarburos, con la técnica conocida como fracking, tiene inconvenientes como usar y contaminar cantidades ingentes de agua, y a las industrias que hacen un empleo intensivo del agua. La Comisión Nacional del Agua (Conagua) se ha comportado de forma cínica y lo ha hecho con alevosía y ventaja a lo largo de 2014 pues estuvo preparando las condiciones para despojar de sus derechos a centenares de miles de agricultores y dejar el camino libre a empresas particulares y trasnacionales que hagan el gran negocio con el agua que pertenece a los mexicanos. El órgano administrativo que dirige David Korenfeld llamado Conagua, cumplió con el proyecto privatizador enviado por el gabinete de Peña Nieto, al contratar compañías que a lo largo y ancho del país se desplegaron en brigadas locales para “verificar” la situación material y jurídica de 450 mil predios donde se estaba aprovechando agua mediante concesiones otorgadas y renovadas sin trampas ni trucos. Los concesionarios se comportaban con simpleza  y contestaban de buena fe pero los agentes verificadores contratados por las compañías privadas al servicio de Conagua, los dictaminaban negativamente, ya que ese era el sentido de la verificación. Por esta razón los pequeños propietarios se van a tener que arreglar con las grandes compañías que se quedarán con el negocio del agua. El negocio del agua destinado al fracking Estos verificadores que no son empleados de Conagua se valían de todo para fundamentar sus reportes negativos. Si una bomba extractora de agua tenía en su cercanía poca maleza porque en previos meses no se había utilizado, debido a los calendarios de siembra y cosecha, el agente tomaba fotografías y anotaba tal hecho como prueba de abandono. Si el agricultor no tenía a la mano los documentos que probaran sus derechos al agua, se le invitaba a no preocuparse y a presentarlos en otra ocasión, aunque el reporte oficial iría en sentido contrario al reportar que carecía de tales documentos.  Pero los agricultores y campesinos decidieron encarar al verificador para exigirle que les dijera de qué se trataba sus diligencias, y el agente verificador les dijo con todas sus letras “se los quieren chingar”, subrayó sus palabras. Estamos gobernados por un gabinete presidencial orwelliano, predador y autoritario, es lógico que las “concesiones de aguas se las quieren quitar con cualquier pretexto”, a los agricultores y campesinos para otorgárselas a las trasnacionales y grandes compañías. Las órdenes que habían recibido los agentes verificadores eran en el sentido de encontrar motivos para cancelar las concesiones individuales en el mayor número posible y renovar lo menos que se pudiera. Para negarles la renovación de sus actuales concesiones “títulos de concesión”, se instaló una figura jurídica precaria, llamada “constancia de registro de obra de alumbramiento”, que para efectos de litigios no reconoce los derechos al agua originales pues antes tenían un “título” más defendible. Los negocios privados  y trasnacionales han visto en México un gran potencial y el agua incluida es un negocio que han arrebatado a los pequeños propietarios y organizaciones comunales así como a las grandes ciudades van a secar a pesar de la encendida oposición de representantes de PRD, Morena, Movimiento Ciudadano, PT,   y todas las organizaciones de izquierda para estar en contra de la intención del Ejecutivo federal y su gabinete presidencial que con la ley Korenfeld están despreciando y minimizando al ciudadano de a pie. Y no sólo afectará el interés de agricultores, y campesinos, sino el de todos los mexicanos que de golpe serán desposeídos del derecho humano al agua, consignado en la Carta Magna (artículo 4º), pero incumplido en la práctica.  Esta maniobra con tufo a corrupción, y falta de sentido social, servirá para maniobrar en las que podría legalizar el trasvase del proyecto Acueducto Monterrey-VI, donde “las empresas del grupo Higa participan con casi el 60% del contrato para un acueducto en el que un grupo privado participa de manera directa en el uso de una cuenca para el suministro de agua potable”, que tiene un costo de más de 45 mil millones de pesos. También se usará para el fracking toda el agua disponible, de otras cuencas sin importar los perjuicios que ocasionarían, a la cuenca de la cual extraen el líquido como en la que apliquen esta práctica sucia y mortal. Finalmente resulta desolador constatar que el grupo en el poder sigue sin comprender los graves desajustes que han provocado las turbias reformas estructurales recientes, de las cuales figuran entre las causas de la crisis política, económica e institucional en la que se encuentra sumisa el país, y aún pretende llevar las lógicas de la privatización como un caos nacional a prácticamente todas las áreas del quehacer mexicano. Si se busca superar las crisis en las que nos han hundido el gabinete de EPN, tendría que empezar a revertir las reformas privatizadoras y aprobadas y abandonar las que están en curso de aprobación, necesitando en este momento a un presidente mexicano y a un legislativo que se preocupe por la nación y por los mexicanos. Si los integrantes del legislativo se someten al Ejecutivo Federal estarían anteponiendo sus intereses particulares frente a los del pueblo  mexicano, lesionando a quienes confiaron en ustedes, no quedando más que reflexionar sobre el servilismo de que fuese sujetos, con lo que además, se expone a la nación, que no habiendo más remedio para los gobernados, ante el cinismo y sometimiento de nuestros gobernantes y legislativo, se tomen acciones diferentes, No defrauden al pueblo mexicano y no olviden que a éste se deben. Si no se actúa en tal sentido se seguirán alterando los conflictos sociales, y la ingobernabilidad ya se manifiesta en diversas zonas por la confusión y el desajuste nacional mexicano. La historia de los negros hace 30 años es la misma que los indocumentados hoy

México.-   El sexenio pasado Estados Unidos lo hizo mediante “centros de fusión bilaterales” pudo penetrar a los organismos de seguridad e inteligencia, y es la eterna historia de la añeja intervención de facto en México de parte de Estados Unidos. Washington ahora anhela hacer formal su presencia al solicitar al gobierno mexicano que los miles de agentes encubiertos puedan portar armas de manera legal. Y Unos se pregunta si los agentes encubiertos mexicanos en el territorio de Estados Unidos traen sus armas legalmente. En estos momentos el “nuevo PRI” es el encargado por medio de Enrique Peña Nieto a proponer a la Cámara legislativa una modificación para que los agentes realicen el sueño dorado de los gringos. La iniciativa federal será reformar la Ley Federal de Armas de Fuego y Explosivos  que el Senado de la República sea enviado el 24 de febrero de 2015. El objetivo es que los aduanales que a diario hacen bajas en los migrantes mexicanos ahora los agentes del ICE, oficiales de Inmigración y Aduanas de Estados Unidos, formen parte de un programa de pre-inspección conjunto, similar al que Washington tiene con Canadá. En Estados Unidos no tienen actualmente el racismo, xenofobia y el odio contra los canadienses. En realidad ahora van a ejercer sus funciones no sólo en las frontera sino que “ejerzan su autoridad en el territorio de otro”, y ahora van a revisar la documentación y consultar bases de datos del movimiento de pasajeros en puertos y aeropuertos internacionales de México, y controlen y supervisen los cargamentos de mercancías de exportación e importación en las aduanas de México. El sueño dorado de la derecha estadounidense se va a hacer realidad. En esta propuesta yanqui se propone que porten  armas reglamentarias calibre 40, y que los escoltas del presidente, ministros y los funcionarios de Estados Unidos puedan usar sus armas en México, “para su adecuada protección”. En el caso de México tenemos una versión infantil, por medio del secretario de Relaciones Exteriores, José Antonio Meade: “se trata de armonizar (…) sin ninguna ambigüedad” la legislación de México con la de Estados Unidos;  en su favor argumentó que los agentes estadounidenses armados  es “importante” y “relevante” para la generación de ”mejores espacios de competitividad” y “prosperidad compartida” en la región interamericana. Racismo contra mexicanos En Estados Unidos “hay una historia de violencia  vinculada a negros y latinos. Si uno ve las estadísticas, el nivel de encarcelamiento es más alto para ellos, pero hay un problema atrás de ello. Cuando no hay oportunidades y acceso a educación, la gente hace lo que sea para sobrevivir. Si eso no se entiende, no se puede comprender la vida en ninguna parte del mundo. Oportunidad significa, al final del día, menos crimen. Yo nunca he cometido uno porque tuve opciones y hoy poseo recursos, pero no sé qué habría hecho si no hubiese tenido esas oportunidades”.  Para Joseph (Joe) López, agregado de agricultura de la embajada de Estados Unidos en México, la situación es clara: “La educación suele ser un elemento que empareja el terreno de juego para todos, aunque no podemos dejar de reconocer que persisten actitudes racistas que suelen determinar, por encima de las capacidades académicas, la obtención de un trabajo, sea uno negro o latino, o provenga de una minoría. Eso pasa en todo el mundo. Lo que no pase puede permitir es que se pierda la vida por cuestiones raciales”. La historia de los negros es compleja en Estados Unidos, asegura, “aunque sea un país desarrollado y ofrezca muchas oportunidades. Hay personas que sufren problemas de discriminación. No es una discriminación violenta, es muy sutil, pero existe. Uno como personas de color, no puede sentarse y decir ya me vencieron, sino debo luchar. ¿Cómo lucha uno? Aprendiendo, con educación, con maestría o doctorado. Eso es algo que nadie te puede quitar”. Atleta de alto rendimiento en su etapa universitaria, Joe López quien es Licenciado en administración agropecuaria en la Universidad de Carolina del Norte, admite que contar con un presidente negro “representa parte de la lucha que hemos dado a lo largo de la historia, pero el camino no está completo, siempre hay más desafíos”, subraya.  En este contexto enfatiza la importancia de hablar abiertamente sobre temas que afectan la vida cotidiana de las minorías. “Sí un negro y un blanco, piden trabajo, es probable que quien deba contratar tenga preferencia por la persona con que se sienta más cómodo. Eso pasa en todo el mundo. Todos tenemos un perjuicio y no necesariamente es malo, aunque debe prevalecer la objetividad”. A guisa de ejemplo, cuando el director Alejandro González Iñarritú (AGI), “recibió (el óscar), pronunció un discurso muy importante, aunque la derecha esté enojada con él”, por aludir al tema de la migración. “Eso hay que hablarlo. La historia de los negros hace 30 años es la situación de los migrantes de hoy.  Es lo mismo. La gente tiene que ser muy objetiva cuando debata esto. Excellon Resources avoids responsibility, environmental and civil in Durango

Excellon Resources evade responsabilidad, ambiental y civil en Durango

México.-   La minera canadiense Excellon Resources, con sede en Toronto Canadá, ha intentado evadir su responsabilidad civil, ambiental y laboral con las comunidades rurales vecinas al yacimiento La Platosa, en Durango, tras violar un contrato de arrendamiento  y las condiciones de trabajo, con el apoyo de diplomáticos canadienses. Dio a conocer la organización Alerta Minera Canadá. En un informe basado en documentos del Ministerio de Asuntos Exteriores, Comercio y Desarrollo de Canadá y respaldado por organizaciones Alerta Minera Canadá y United Steelworkers, denunció la violación de normas laborales y ambientales en Durango, en un análisis de 250 páginas elaborado a partir de lo ocurrido en la Platosa desde mediados de 2012. “Información  del gobierno canadiense revela respaldo de la embajada de Canadá a los abusos de la minera en México”.  Por ejemplo, entre julio y noviembre de 2012 se intensificaron “el conflicto y la represión” contra habitantes de las localidades de Bermejillo, Tlahualillo (La Sierrita) y Mapimí, Durango. Según el informe, miembros del ejido La Sierrita y trabajadores de la sección 309 del sindicato minero en La Platosa realizaron una protesta pacífica durante varios meses, luego de anteponer quejas formales en Canadá por violaciones graves a los derechos humanos y a las normas ambientales, “sin resultado”. El líder es desconocido pero retienen el manantial Ahora se sabe que a pesar de estas quejas y de que Excellon se negó a dialogar, “la embajada de Canadá compartió  con la empresa información recabada entre ejidatarios y sus abogados sin consentimiento de ellos, mientras ayudaba a crear relaciones con las altas esferas, lo que llevó a la represión de la protesta. “Los documentos internos que se examinaron no muestran evidencia alguna de que Canadá fomentará en las empresas un comportamiento responsable y respetuoso de los estándares internacionales, como suele afirmar que es su política”, sostiene el informe. “El apoyo unilateral de la embajada de Canadá a Excellon es un claro ejemplo de la promoción de los intereses de las empresas que realiza el gobierno canadiense a costa de los trabajadores y de las comunidades”. Lo más grave destaca Ken Neumann, es que un delegado comercial estuvo al tanto de una reunión entre la policía, el Ejército y otras autoridades del gobierno mexicano para planear el desalojo de la protesta y una noche antes expresó sus buenos deseos a la compañía. “La indiferencia que la embajada parece demostrar hacia la seguridad de los manifestantes en un país donde demasiadas veces se asesina a defensores de los derechos humanos, periodistas y dirigentes comunitarios es horrorosa”, concluyen las organizaciones antes mencionadas. Cuarenta miembros del PRI bloquearon el paso a la comunidad de Zacualpan, Colima para impedir  a una comitiva internacional de derechos humanos observar las condiciones en que se encuentra la comunidad nahua, confrontada desde la llegada del consorcio minero internacional Gabfer SA de CV, que busca explotar oro y platino a cielo abierto. El grupo también planea inspeccionar el balneario Ojo de agua, ocupado desde el 28 de diciembre pasado por el grupo de Carlos Guzmán Teodoro, ex presidente de bienes comunales, destituido por la mayoría de los habitantes de la comunidad nahua, por apoyar la instalación  de la mina, que, según los inconformes, contaminará el manantial que abastece a la zona conurbada Colima-Villa de Álvarez, habitada por mas de 300 mil personas. Jennifer Moore, coordinadora del programa para América Latina de Alerta Minera Canadá, acusó a los comuneros de filiación priísta, vinculados a Guzmán, de impedir el trabajo de la misión nacional e internacional de observación sobre el caso Zacualpan y señaló  que la patrulla 1401 de la policía estatal apoyó el bloqueo, pese a que constituye un delito. Clausuran yacimiento en Sinaloa Moore recordó que en noviembre de 2014 la comunidad indígena destituyó a Guzmán en una asamblea “pacífica, notariada y reconocida por las autoridades. Por ende, su grupo ya perdió todos sus privilegios”. Pese a ello retienen el manantial Ojo de agua y con el bloqueo “ahora pretenden imponer su voluntad con apoyo de la policía estatal”. En un comunicado, Moore advirtió que la impunidad del grupo de Guzmán y la omisión de las autoridades podrían desencadenar mayor violencia, medios y actores sociales y políticos nacionales y extranjeros han advertido de manera insistente que no aplicar la ley podría derivar en más violencia, con graves consecuencias para a población indígena y para los gobiernos federal, estatal y municipal. Sin embargo los golpeadores del PRI “insisten en amedrentar a la población    y por ello pedimos a las autoridades que se garantice la seguridad de la misión y de la comunidad”.    La Profepa clausuró temporalmente una mina en el poblado El Nuevo Placer, cerca de la comunidad de La Noria, municipio de Mazatlán, al detectar daños a la vegetación. La mina no cuenta con autorizaciones de impacto ambiental y cambio de uso de terrenos forestales, informó la Profepa en un boletín. La organización federal no dio a conocer el nombre de la empresa que explota oro y plata a tajo abierto y carece de planta de beneficio. Se detectó eliminación de especies naturales y daños a ejemplares de mauto, palo de Brasil, palo blanco debido al uso de tractores de banda y retroexcavadoras en 30 mil metros cuadrados. La Profepa ordenó a mediados de diciembre pasado la suspensión de actividades de la minera Paradox Xingye, ubicada en el municipio de Choix, luego del derrame de unos 700 metros cúbicos de aguas lodosas por la ruptura de un contenedor de aguas residuales. En octubre de 2014, en el municipio de Concordia , la mina Dos Señores, ubicada cerca del arroyo Chupaderos, que desemboca en el río Presidio, vertió unas 10 mil 800 toneladas de residuos tóxicos al agua, afectando actividades productivas y la disponibilidad para consumo humano. Estuvo al servicio del PAN, y en Hacienda diagnosticó  que la crisis estadounidense no le produciría a México un catarro. Como no dio buenos resultados ahora lo tenemos como gobernador del Banco de México con el PRI en el poder, y ambos: Felipe Calderón y Enrique Peña Nieto comparten el dudoso mérito de que se han registrado las mayores devaluaciones en el país. Mexico. -   With the electoral process 2015 set in motion, in the offices of the magistrates of the electoral Tribunal of the Federation (TEPJF, for their initials in Spanish) they still remain without solving the resources around the expenses of the federal campaigns of 2012, and with it lacks to elucidate the legality of the polemic lattice that the PRI mounted to tie Enrique Peña Nieto victory, with Monex Bank like key element of an illicit financing and that it already turns two years without being clarified the original complaint on the used credit cards.
