Se genera un nuevo andamiaje legal con la promulgación del SNA

México. -  Cincuenta días antes de que el presidente Enrique Peña Nieto (EPN), expresará su mea culpa por lo que llamó error y esto se relaciona con su lujosa residencia de 7 millones de dólares que su ex esposa “La Paloma”, compró en colonia lujosa llamada Las Lomas, a un constructor favorecido por su gobierno, Joaquín Vargas dueño del grupo comunicador MVS, interpuso una demanda por “daño moral” contra la periodista  Carmen Aristegui, por lo que ésta expresa en el prólogo de su libro La Casa Blanca de Peña Nieto la historia que cimbró un gobierno, escrito por los cuatro reporteros que develaron el caso: Daniel Lizárraga, Rafael Cabrera, Irving Huerta y Sebastián Barragán. Esta demanda de “daño moral” entraña “un grave riesgo de afectación patrimonial” para quién fue la conductora más popular de la radio mexicana precisó su abogado defensor, Javier Quijano, El penalista añade, “Carmen es objeto de una persecución política. Destruir el prólogo que escribió para el libro equivale a tomar los prólogos incómodos de todos los libros que se publican y quemarlos en una hoguera en la plaza pública”, al estilo fascista de Hitler. Frente a representantes de los poderes de la Unión, el presidente EPN realizó en Palacio Nacional el lanzamiento del sistema Nacional Anticorrupción (SNA), antes en el que señaló  que ante la indignación ciudadana por la proliferación de este “cáncer social” es imperativo “ser autocríticos y vernos en el espejo””. Acto seguido recordó el caso de la llamada “Casa Blanca” y reconoció: “en carne propia sentí la irritación de los mexicanos; por eso, con toda humildad pido perdón”. A 19 meses de que se difundió el presunto conflicto de intereses asociado  a la casa de su esposa, Angélica Rivera, la ceremonia solemne de promulgación de las leyes del SA sirvió de escenario para una autocrítica, ante la representación de los poderes judicial y legislativo, y casi todo su gabinete, en primera fila el secretario de Hacienda, Luis Videgaray, involucrado en un caso similar.  El mandatario indicó: “en noviembre de 2014, la información difundida sobre la Casa Blanca causó gran indignación. Este asunto me reafirmó que los servidores públicos, además de ser responsables de actuar conforme a derecho y con total integridad, también somos responsables de la percepción que generamos con lo que hacemos, y en esto reconozco, cometí un error. No obstante que me conduje conforme a la ley, este error afectó a mi familia, lastimó la investidura presidencia y dañó la confianza en el gobierno”. El primero en salir fue el funcionario, Virgilio Andrade (VA), renuncia en mano para dar paso a su jefe y se pueda cumplir  con las Reglas del SNA, luego entra a escena el presidente EPN a fin de promulgar el sistema anti corruptelas y aprovechar el sentido momento “histórico” –aseguró EPN- para pedir a los mexicanos “perdón” por el “error” de haber permitido una percepción errónea de un acto limpio, de lo cual se encargó el anterior burócrata VA, por la amistosa  adquisición en abonos de la mansión Casa Blanca; y se cierra un episodio de la telenovela de la actriz en pausa, Angélica Rivera Hurtado, hizo saber que había firmado con los honrados agentes de Grupo Higa un “convenio de terminación” del contrato de compraventa, de manera que los amables agentes callejeros se quedan con las rentas  del tiempo ejercido, le devolverán los pagos y adelantos que había hecho, incluso con los correspondientes intereses. Todo esto no tiene ya nada que ver con la residencia ubicada en la calle Sierra Gorda, en las Lomas de Chapultepec. De los episodios de novela rosa el más comentado fue el del perdón, Dice EPN “nos sentimos lastimados y dolidos”, pero antes de que alguien supusiera que se tramitará el encarcelamiento del presidente, y de algunos directivos de OHL, y en su caso de muchos de los secretarios y directores del gabinete presidencial que se dedican a la alegre cosecha de comisiones porcentuales y motivaciones en efectivo, a la patria hizo saber que el destinatario  escogido para las duras palabras era él mismo. Cuando empezó con aire valiente, y alguien creyera que iba a pronunciar la frase: “defenderé la Casa Blanca como un perro”, reconoció que generó “indignación”, pero en noviembre de 1994 si saben de esa operación de altos vuelos no incluyó al equipo de periodistas que provocó tales daños domésticos, el encabezado por Carmen Aristegui, despedidos del grupo radiofónico MVS ella y los demás reporteros ni que hasta hoy se hayan podido recuperar como propuesta periodística en ningún otro grupo de medios electrónicos, hay versiones que tienen encima de ellos un veto sexenal en su contra, así que la disculpa de EPN pudiera consistir del retiro de censura, vano sueño, oh, sí. En este contexto de tráfico de influencias y conflicto de intereses del presidente no entiende que la compraventa que aceptó fue gestionada por trámites generosos de un contratista, Hinojosa del Grupo Higa, muy beneficiado en el Estado de México, y posteriormente en el gobierno federal, al grado que agradecido haya buscado la manera de acercar un techo de lujo a la amable familia Peña-Rivera. Lamento el derrumbe moral Al final del encuentro con la prensa se dio a conocer un video que Aristegui grabó minutos antes, en el que se dirige personalmente al presidente EPN, quien apenas cuatro días había “pedido perdón” por el “error” de la Casa Blanca. “¿Cuál es el verdadero alcance? Y de ¿Qué perdón habla Sr. Presidente? Pide perdón  por la Casa Blanca pero no cesan los ánimos de venganza. Sr. Presidente, deje de mecer esa cuna”. En el mensaje de Aristegui, señala que “en cualquier otro país con un verdadero estado de derecho se hubiera realizado una investigación, un impeachment y un juicio político al presidente, y probablemente al presidente se le hubiera obligado a renunciar. En México no. El jefe del Ejecutivo sigue en funciones y los periodistas que alentamos la investigación fuimos echados del aire de la radio mexicana. Sabemos  que no regresaremos a ella, por lo menos hasta que se acabe este sexenio. El abogado Quijano, quien ha acompañado la defensa de Carmen Aristegui en el intrincado laberinto judicial  en el que se encuentra desde marzo del año pasado, cuando ella y su equipo fueron despedidos por la familia Vargas, y se tienen cinco demandas Al respecto derivadas en distintos juzgados. El abogado defensor explicó  que la acusación de origen, según el demandantes, es que Vargas “se sintió ofendido” por algunas expresiones del prólogo.  En una de ellas, la autora expresa que la concesionaria MVS fue “inducida”  a hacer   “cosas tan indecentes” y deplorables que quinees conocemos a sus dueños y directivos nunca imaginamos”. Añade: “Personalmente lamento el derrumbe moral de Joaquín Vargas y sus hermanos… Lamento mucho también la carga moral que han trasferido al resto de la familia Vargas. Son personas a las que conozco y aprecio desde hace muchos años”. En otro párrafo alude: “Fue una tragedia ver como aquéllos que habían apostado por la libertad de expresión y la investigación periodística finalmente sucumbieron a presiones y componendas con el poder que ya antes habían enfrentado con dignidad y valentía”.  De prosperar esta demanda por “daño moral”, la afectación patrimonial contra la acusada sería “muy grave”, ya que, recordó el abogado defensor, la Suprema Corte (SCJN), eliminó los topes máximos de las sanciones económicas incluidas en la Ley de Responsabilidad civil para la protección a la vida privada. The magisterial movement condenses the struggle of many causes: Churches and NGO

Mexico. -  Representative of Churches and social organizations expressed their solidarity with the magisterial movement. In a pronouncement made known by the Observatory Ecclesial, called to the solidarity and the collective action, community and popular in defense of the lay education, free, and of quality, "that the governmental strategy and organizations private from makes three decades is pawned obstinate and unfruitfully in dismantling". Organizaciones expresan solidaridad con las demandas de los mentores

El movimiento magisterial condensa la lucha de muchas causas: Iglesias y ONG

México. -  Representantes de Iglesias y organizaciones sociales expresaron su solidaridad con el movimiento magisterial. En un pronunciamiento dado a conocer por el Observatorio Eclesial, llamaron a la solidaridad y la acción colectiva, comunitaria y popular en defensa de la educación laica, gratuita, y de calidad, “que la estrategia gubernamental y organizaciones privadas desde hace tres décadas se empeña tozuda e infructuosamente en desmantelar”. Afirmaron que el movimiento magisterial es “una oportunidad imperdible para la articulación de muchas causas, en grado tal  que podamos detener la barbarie que no escampa e iniciar un auténtico proceso de recuperación nacional desde el pueblo y para los pueblos”.  Resaltaron que México  vive uno de los momentos  más difíciles de su historia, en el que “lo que se acumula día con día no es el bienestar ni el desarrollo, sino la tragedia, la corrupción y la represión; donde crece la inconformidad social a la par que la sordera gubernamental frente  al clamor de millones”.  Destacaron que ante la “insoportable realidad, pueblos, movimientos sociales, sectores religiosos se levantan y alzan la voz por doquier, de forma pacífica y organizada,  como recientemente lo ha hecho el movimiento magisterial en oposición a la mal nombrada reforma educativa”.  Decenas de organizaciones no gubernamentales y personajes de distintas iglesias, entre ellos el obispo Raúl Vera; el reverendo Dan González , rector de la Comunidad Teológica de México; presbíteros, Cencos y el Servicio Internacional Cristiano de Solidaridad con los pueblos de América, plantearon que el movimiento magisterial se condensan y simbolizan, entre muchas otras, las demandas estudiantiles por una educación de calidad y las de normales rurales, cuyo emblema sigue siendo “Ayotzinapa, hasta encontrarles”. Demandaron poner fin a la reforma laboral en materia educativa, “empezando por la anulación inmediata de las inconstitucionales e irracionales evaluaciones docentes”.  Asimismo que el gobierno federal abandone la intransigencia y atienda las demandas de diálogo abierto con el magisterio, y que cesen el hostigamiento y la represión a la libre manifestación de los maestros, así como de los defensores de derechos humanos, periodistas, estudiantes, movimientos populares y cualquier forma de participación social organizada, (La Jornada, Alma Muñoz). Halconazo Ante estas evidencias de la represión en contra de los maestros no sería ocioso acudir al recuerdo del halconazo de hace 45 años. En donde se demandaba cesar a la impunidad que aún hoy nos ocupa y no olvidemos que es la condición sine qua non para tener justicia y libertad, esos 45 años han pasado como una exhalación  para los estudiantes, maestros y ciudadanos que salieron a machar ayer (10/06/16), y recordaron que los hechos criminales del 10 de junio de 1971 no sigan impunes. “Esta marcha tiene el mayor de los sentidos, porque es necesario pedir el cese de la impunidad que protege a los poderosos, que es el primer paso para avanzar a la construcción de un país de libertades”, dijo en el Zócalo de la CDMX, Félix Hernández Gamundi (FHG), del Comité 68, a quien correspondió abrir el mitin con el que se exigió justicia para las víctimas del jueves de Corpus. Afirmo que México vive una “crisis terrible de los derechos humanos y no lo podemos permitir. Tenemos que sumar voluntades hasta construir un modelo nuevo de país.  Sí no lo hacemos saliendo a las calles y levantando todos la voz, vamos a dejar el espacio libre para que avance el proyecto de militarización y autoritarismo fascista que se está imponiendo”. La manifestación salió a las cuatro de la tarde de las afueras de las instalaciones del IPN en el casco de Santo Tomás, el mismo lugar de donde partieron   los estudiantes agredidos por el grupo paramilitar los Halcones en 1971. Los manifestantes de ayer eran unos 300 cuando comenzaron la caminata pero dos horas más tarde, cuando llegaron a la plaza de la Constitución, unos 2 mil 500. Adelante iba el Comité 68 y varios de los entonces estudiantes que participaron en la marcha reprimida en el sexenio de Luis Echeverría Álvarez. Detrás de ellos iban alumnos del IPN eran en su mayoría adolescentes de las vocacionales. “Las calles son nuestras”, dijeron los jóvenes cuando pasaron por el Metro Normal donde los del Comité recordaron la agresión de policías y de los paramilitares llamados halcones armados con palos y armas de fuego, liderados por el Secretario de Gobernación Alfonso Martínez Domínguez. También participaron maestros de la CNTE así como organizaciones sociales, entre ellas el Frente de Pueblos en Defensa de la Tierra. Los organizadores llamaron en todo momento a mantener una marcha pacífica. A la altura del Puente Alvarado, antes de llegar a las instalaciones del PRI de la CDMX, se integró un grupo de jóvenes vestido de negro, la mayoría con el rostro cubierto. Granaderos y policías de tránsito capitalino realizaron el seguimiento constante del contingente, Salvador Almanza secretario de organización de la sección 18 de Michoacán, dijo en el mitin en nombre de la CNTE: “Venimos aquí para decirles que estamos con ustedes, dispuestos a salir a las calles y marchar juntos en defensa del país”. México. -  Después de 78 años en la historia de México, el consejo de administración  de Pemex aprobó este viernes (10/06/16) su primera asociación para la exploración y explotación del campo Trión en aguas profundas del Golfo de México (GM) –se encuentra en la frontera marina con Estados Unidos- compartiendo con petroleras rivales los riesgos geológicos y económicos, informó en conferencia de prensa el director de la petrolera del estado, petróleos Mexicanos (Pemex), José Antonio González Ayala (JAG). El campo Trión  fue descubierto en 2012 y tiene una extensión de mil 259 kilómetros cuadrados y está ubicado 200 kilómetros al este de Matamoros y a 179 kilómetros de la línea de costa, en aguas ultra profundas del Golfo de México a un tirante de agua superior a 2 mil 500 metros y forma parte de la región llamada Cinturón Plegado de Perdido. Del lado estadounidense la explotación en aguas profundas del Golfo de México se realiza en campos Great White, Silvertip y Tobago Chevron y BP y son operados por la angloholandesa Shell.  Las cuatro megacorporaciones petroleras internacionales, que en el pasado integraban el influyente grupo conocido como las Siete Hermanas y que durante décadas fueron propietarias del crudo mexicano, intentan regresar al país como licenciatarias y recuperar la explotación de yacimientos petroleros, ahora en aguas profundas del Golfo de México. Se trata de la británica BP, la angloholandesa Shell, las gigantes estadounidenses Chevron y ExxonMobil (que antes operaban de manera independiente), las cuales concluyeron el pasado 3 de junio su proceso de precalificación para el concurso de contratos de exploración y explotación de hidrocarburos por un plazo máximo hasta de medio siglo. El contrato licencia, figura que estuvo prohibida por la Constitución en los pasados 76 años, permite a las compañías petroleras privadas nacionales y extranjeras ahora explotar los yacimientos petroleros, a cambio del pago de regalías e impuestos con una tasa máxima predefinida en el contrato.  El Secretario de Energía, Pedro Joaquín Coldwell, externó su beneplácito y destacó  que con este acuerdo Pemex obtendrá tecnología de punta y el proceso se realizará con absoluta trasparencia y se alineará con el de la ronda 1.4 del gobierno federal.  El campo pasará a ser una asignación en exclusiva otorgada a Pemex en la ronda cero a un contrato de licencia, y éste será analizado con la asistencia técnica de la Comisión Nacional de Hidrocarburos (CNH). Los nombramientos se aprueban Una vez que tenga el contrato y las bases la Hacienda federal de México (SHCP) fijará el régimen fiscal. Se espera que el proceso de migración se inicie en julio próximo, cuando se presentará la licitación y concluya en diciembre de 2016, anunció el director general de Pemex. El director de Pemex JAG,  dijo que los términos económicos todavía no se han definido y el operador será otra empresa que tenga la experiencia. Precisó que la convocatoria se hará a finales de julio.  De acuerdo con la experiencia internacional, explicó, podrían ser dos o tres socios y el número de participantes, lo determinará el interés de las compañías petroleras internacionales. El monto de inversión es de 11 mil millones de dólares con un potencial de reservas posibles de 480 millones de barriles de petróleo crudo ligero. Además precisó que los recursos provendrán de los programas de inversión y de captación de financiamiento. Aclaró que debido a los apoyos gubernamentales las necesidades de financiamiento se han reducido. Indicó que la meta de extracción de crudo a nivel nacional se mantendrá este año en 2 millones de 130 mil barriles diarios. Pemex tendrá acceso a la tecnología y los recursos serán parte del programa de inversión de la ahora empresa improductiva del estado. Por otro lado, el consejo de administración de Pemex aprobó el nombramiento de Luis Rafael Montanaro Sánchez como nuevo director general de la empresa en liquidación subsidiaria Pemex Etileno.  También se autorizó a Manuel Salvador Cruz Flores como subdirector de Contabilidad y Fiscal en la Dirección Corporativa de Finanzas. Si el petróleo como la educación tuviera aguerridos defensores de la cultura, con el magisterio nacional depositados en la CNTE, no tendríamos esta liquidación de Pemex y regalando parte de la información, desmantelamiento de la infraestructura de la petrolera antiguamente propiedad del estado. Esta venta de cochera y gradual desmantelamiento total enviada su propiedad al extranjero, pero halla otros modos de financiamiento para conseguir dinero físico, y así tendremos que se han colocado bonos por 8.1 mil millones de dólares  y su director JAG, dijo el mes pasado es un hecho que esta vía está finalizando. Aunque este financiamiento es costoso, se acordó pagar  un tipo de interés de 8 por ciento un esquema de venta-arrendamiento por mil 200 millones de dólares según Bloomberg. Al parecer el trato es  vender instalaciones petroleras y luego las retoma a los nuevos daños en arrendamiento financiero. En este contexto de liquidación disfrazada, si el pueblo mexicano quisiera recuperar la soberanía sobre su petróleo que estos cínicos sin patria han estado desmantelando suavemente a la petrolera nacional, el gobierno federal patriota y el pueblo mexicano sólo hallarían despojos de lo que fue un día la importante y estratégica petrolera mexicana. Las autoridades están cobrando conciencia de que la irritación existe

México.-   La intervención del presidente Enrique Peña Nieto en el acto de promulgación de las leyes secundarias del Sistema Nacional Anticorrupción, durante el cual pidió perdón a los ciudadanos “por el agravio y la indignación causados por la compra  de la Casa Blanca, constituye un gesto positivo en un gobierno que en lo que va de su gestión no se ha caracterizado precisamente por sus manifestaciones de ese tipo. La declaración contrasta de manera notoria  con las reacciones que desde el propio entorno presidencial surgieron a finales de 2014, que fue cuando la adquisición, el precio y las características del citado inmueble fueron públicamente conocidas, y en las cuales se mezclaban la negación, la minimización del hecho  y también el silencio. En México, el tema de la corrupción va estrechamente ligado al de la ostentación, y a la riqueza, que en un país afectado por múltiples carencias e inaceptables indicadores de pobreza  resulta doblemente ofensivo. De ahí el costo que iba a ser vivienda presidencial, su aparatosa opulencia, resultaba difícilmente compatibles  con la austeridad que debía evidenciar el jefe de una administración que en sus inicios había prometido atenuar desigualdades y terminar con privilegios. Por lo demás, que el Sr, presidente asegure comprender y sentir la irritación de los mexicanos, lo cual se evidenció en los comicios  de junio pasado donde su partido, el PRI obtuvo resultados peores de los que se esperaban. Este resultado es un saludable cambio respecto de las consideraciones que hace tres meses formuló sobre el “malhumor social”, sino parece indicar que las autoridades están cobrando conciencia de que esa irritación existe y tiene razón. Es apropiado y significativo que las expresiones presidenciales se viertan junto a un paquete de leyes anticorrupción que debería aplicarse en la realidad. Es momento de señalar que es apenas el inicio escabroso y largo camino que será preciso recorrer para reducir drásticamente, y extirpar la auténtica plaga social de la corrupción. La corrupción y la impunidad ocupa un lugar muy alto en la lista de preocupaciones que agobian al pueblo. Esto se refleja en el índice de corrupción elaborado anualmente por Transparencia Internacional, y el país recibió una puntuación de 35 puntos en 2015. De la eficacia de los instrumentos legales que implica la creación del Sistema Nacional de Anticorrupción, se necesita la voluntad y decisión  para usarlo que  muestren los organismos públicos y los funcionarios encargados de su aplicación legal, y esto dependerá el éxito que se alcance en la lucha contra este pernicioso hábito. Todo esto en teoría es muy bueno pero si el ejecutivo nacional no le da medidas para darle continuidad, y que la impulsen más allá del carácter nominal y las continua observando haciendo extensiva a las estructuras gubernamentales, tanto públicas como privadas no serán una realidad plausible. Los periodistas afectados La periodista anunció que la hostigarían por parte de la Secretaría de Gobernación, por medio de la “secreta” -agencia de investigación de la SG para hostigar a los periodistas y opositores políticos- , días antes de la pronunciación del discurso del perdón, por lo que se han intensificado la presentación de demandas judiciales en su contra, relacionadas con la obra “Casa Blanca”.  No es un dato menor que la escalada de agresión coincida con el anuncio de que su equipo está por iniciar un proyecto de periodismo a través de Internet. Ante estos hechos, el discurso del perdón es una treta preventiva del gabinete presidencial, una taimada fórmula de auto-exculpación anticipada. Este tipo de agresiones en curso le suceden al escritor Sergio Aguayo, bajo demanda de Humberto Moreira, ex gobernador de Coahuila, a causa de un escrito en el que habló del hedor de impunidad y corrupción. Demanda en la que se involucra a Jesús Ortega Martínez (PRD), la periodista Sanjuana Martínez, con una sentencia en contra, en proceso de revisión, y al perder el recurso legal, ya se maneja un monto de pago, y en caso de no pagar se determina el embargo. Al respecto, Rogelio Hernández López, periodista que se ha especializado en la organización y defensa del gremio de periodistas, escribió: amedrantar con la aplicación de la ley para silenciar a un periodista. Si prende esa demanda –en contra de Aguayo-  será por fuerzas extralegales y el mensaje cundirá por todas partes de México. Si lo acallan a él, será más fácil con otros menos fuertes. El caso es rodeado por la atmósfera nacional de agravios contra periodistas mexicanos, para silenciar”.  En esta circunstancia, “son demasiados los indicadores: amenazas directas o indirectas, presión a sus empleadores, agresiones verbales, y físicas, o asesinatos. Hasta ahora, el tipo de agresión menos usada por políticos y particulares es la presión jurídica. Pero se han creado más restricciones y sombra que amenazan a la libertad de expresión. En estos tiempos de cambios los códigos civiles se han modificado para que los ciudadanos se defiendan  del periodismo mal ejercido, pero ya hay normas y reglas para restringir el libre flujo de ideas y opiniones”. (http://goo.g1/DjkIXc). Cajón de sastre Por otra parte, la CNTE se queja que el gobierno federal financia “grupos de choque” para “reprimir el movimiento magisterial. Sin embargo a las invitaciones al doble discurso que maneja la administración federal para reprimir y enfadar a los maestros. El magisterio disidente reiteró que el gobierno federal va en un carril con doble sentido pero el magisterio disidente dejó de manifiesto tres puntos para dejar en claro cómo llegar a acuerdos.  Adelfo Alejandro Gómez, dirigente del grupo de Chiapas, aseguró  que el gobierno federal utiliza paramilitares  que “hoy están accionando, pretendiendo con ello dar a conocer que la sociedad ya no nos da su respaldo; (eso) es falso.
