México. – El gobierno de Donald Trump formula tácticas para llevar a cabo su “guerra contra los inmigrantes”: la cifra ronda los 11 millones de indocumentados en Estados Unidos, y en su mayoría son mexicanos. Estos documentos “a priori” fueron filtrados el fin de semana, primero a los periódicos McClatchy y después de Washington Post y Reuters, aunque todavía están bajo supervisión de abogados de la Casa Blanca, y podrían ser aprobados esta semana. Michael Kelly, secretario de Seguridad Interior, justifica las medidas con el argumento de que “la oleada de inmigración en la frontera sur ha desbordado a las agencias federales y los recursos y ha creado una significativa vulnerabilidad de seguridad nacional para Estados Unidos”. El mayor impacto que tienen las medidas agresivas del gobierno federal estadounidense es definir prioridades de persecución de los mexicanos en el extranjero, que pone en riesgo su libertad de movimiento y trabajo. Ante esta dramática realidad el inmigrante será condenado por un delito y sujeto a la deportación inmediatamente, o en personas que cometan delitos y actos “que pudieran constituir” un delito; que haya cometido fraude; o que haya mentido en relación a un asunto oficial ante una agencia gubernamental; o que haya “abusado” de los servicios públicos, que esté bajo órdenes de abandonar el país; o que “a juicio de un oficial de inmigración represente un riesgo a la seguridad pública; o la seguridad nacional”. Ante este panorama los 11 millones de personas caben en alguna parte de esta lista general. Se establece que los indocumentados detenidos con excepciones no van a ser liberados antes de sus citas en los tribunales de inmigración, lo cual implica que va a durar semanas y tal vez años de espera y separación de familias. Ante esta circunstancia establecida por las autoridades de inmigración, José Pertierra abogado de migración, menciona que las nuevas definiciones son amplias que cualquiera haya cometido una infracción o delito menor será sujeto a deportación. Muros que separan a dos países Se supone que si se lleva un cliente ante un tribunal estadounidense que tiene un solo antecedente delictivo, por ejemplo; mentirle a una autoridad sobre sus documentos, o ser arrestado por manejar “bajo la influencia” de alcohol, y que podría ser sujeto a ser detenido ahí mismo. “No sabemos qué hacer ante eso; estamos ante una situación en la que presentar a un cliente Ante un tribunal es como llevar a un cristiano a los leones en la época romana”. Otra medida permite que todo inmigrante mexicano sea detenido en la frontera sea de inmediato regresado a México para esperar la conclusión de sus audiencias sobre deportación, evitando así que sean detenidos en instalaciones estadounidenses. Las medidas de guerra se enfocan en frenar el flujo de menores de edad no acompañados, aproximadamente son 155 mil en los últimos tres años, e incluyen vigilar de cerca a sus padres en Estados Unidos, para que sus hijos no lleguen por manos de traficantes. El gobierno federal dispone que la Agencia de aduanas y Control Fronterizo (CBP). “De inmediato inicie la planeación, diseño, construcción y mantenimiento de un muro” fronterizo. Esta orden superior del gobierno aclara que será en “lugares apropiados” y empleando “materiales y tecnología apropiada para lograr un control operativo más efectivo de la frontera”, lo anterior deja en la incógnita si se contempla un muro físico a lo largo de la frontera, y es ambiguo si deja generar los fondos para financiar el muro milagroso. Los documentos incluyen instrucciones para iniciar la contratación de 10 mil agentes adicionales de la agencia de control de inmigración (ICE), y 5 mil más para la patrulla Fronteriza cómo se indica en la órdenes ejecutivas de Trump. Esta acción se complementará con el programa de colaboración de las agencias federales con policías locales para la persecución de inmigrantes indocumentados. Estos nueve programas son vinculante a la persecución de mexicanos en el extranjero promulgado por Bill Clinton y secundado en su oportunidad por Barak Obama, que refleja la vulnerabilidad del sistema estadounidense. Y refleja a dos países diferentes como en la región de Cachemira entre Pakistán y la India, o el muro que separa a Corea del Norte y Corea del Sur, o el muro que separa a Israel y Palestina. En esta circunstancia, México deberá negociar el tratado que desde 1944 tendrá que negociar y está vigente sobre los derechos de agua del río Colorado, que alimenta al lago Meade, y México deberá defender a la comunidad latina de México y negar el agua a los Estados Unidos. México deberá negar la entrada de las agencias de seguridad en los aeropuertos y aduanas de México, y deberá comprar sus insumos de maíz, frijol y otras compras de vegetales, a otros países como Argentina y Brasil. Estas medidas agresivas remplazan las medidas de Barak Obama de dirigir los esfuerzos de deportación sólo contra criminales reincidentes y aquellos que tienen vínculos con el “terrorismo”. Se observa en estos documentos la ausencia del Programa de Acción Diferida para los llegados en la infancia (Daca, por sus siglas en inglés), establecidos por orden ejecutiva de Obama, que beneficia a 750 mil jóvenes indocumentados. Alrededor de Daca, Trump ha repetido que buscará una solución para muchos de estos jóvenes su ausencia y recordó que algunos “criminales” tienen un ”gran corazón”. Esta información se filtra cuando se revela que se está considerando el uso de 100 mil elementos de la Guardia Nacional en 11 estados, para agredir a los criminales mexicanos en el extranjero, lo cual provocó pánico y furia entre diversos sectores. Este memorando no se presenta en los documentos de Kelly. El gobierno de Trump está decidido a infligir crueldad sobre millones de familias de mexicanos en el extranjero sólo porque son indocumentados e inmigrantes. Estas políticas son una “combinación sin precedentes de acciones inconstitucionales radicales” al hacer a casi todo inmigrante, “una prioridad para la detención y deportación”. Joanne Lin, abogado de la Unión estadounidense de libertades civiles (ACLU), subraya, “unos 11 millones viven en este país, fuera de la ley. De repente, por decreto presidencial, todos son prioridad, todos son prioridad para la deportación, todos son criminales, todos son amenazados con destruir su vida, junto con miembros de sus familias. “El fin para ellos puede llegar en cualquier momento” inesperado, predice el editorial del New York Times. Se comenta que los inmigrantes se sienten “fugitivos… aterrorizados de que el gobierno de Estados Unidos los encontrará y les exigirá sus papeles y al no tenerlos se los llevará a la prisión. El periódico invita a resistir toda esta arbitrariedad con “el poder de la gente”, ante la limitada reacción y poder de legisladores opositores y de los tribunales.
